    Pre-Ban Mag Legality Scenario.

    Say my older brother had some pre-ban G17 magazines. He moves to NY, and I find his old G17 mags in an ammo can at the house.

    Legally speaking, can I take those magazines? They will not be "given" to me, they are not imported, or manufactured. I just stumbled across these.

    If you find them, I think its legal. But I dont know for sure. Does he know they were there, maybe thats where he was storing them.

      What if they were your mags to begin with? I believe finding mags is GTG but someone else can confirm.

        Well, he no longer lives in CA, he'll be in NY for a long while, and I think he left the mags here because you can't own standard capacity mags in NY as well.

            As much as I'd like to play it this way, I am turning 21 in a matter of months. No one in the right mind would believe that I've had these pre-ban mags when I was 11.

              So you came across some mags that aren't yours, you know who they belong to and you are going to make no attempt to return them. How is this not thievery? If your brother knows that you have them and lets you have/use/posess them, how is it not a loan agreement between you two? I am no cop, but if I was, and someone was stupid enough to use the "I found it" line with regard to high caps then they'd be in trouble. Considering you have already posted your story here, it wouldn't make much sense to tell you to find a better reason why you have them - not that you need a reason (Miranda/5th Amendment).

                cause if he did, he would be committing a felony by sending them to NY which has laws about hi-caps too.

                  Lets not jump into any conclusions here. I am stating the facts. I never said that I took possession of them. They are still at the house. I don't even own a Glock. I am speaking on future events that may or may not occur, depending on the legality of the situation.

                      Sell them as rebuild kits if your brother or you cannot use them. Takke them apart firstthen sell them here on cal guns!

                        I think what the OP meant to say is that this situation is all hypothetical. If he did in fact find these mags in his house (by chance), he would be smart, not say or post anything here about it, and happily use said mags without EVER saying a word about them. If asked, he would take the 5th.
