    Question

Probably been asked before, but maybe mine is more specific?!

Let's say I see a Colt King Cobra for sale on gunbroker. The seller is in TX. Can I purchase that gun if I live in California? The King Cobra isn't on the approved list, but it hasn't been produced since the mid-1990's?

*I saw one guy selling a Colt 1911 WWI reproduction (limited run of a 70 series) in California! How'd he do that?!?!

It would already had to have been in CA. The only way to buy/acquire a non-roster handgun is through a private party transfer between Two California residents. This could be from a LEO (who are exempt from the roster), military who permanently reside in CA but are stationed out of state, or a Dual state Resident.

      Thanks.

I thought an LEO needed to provide a letter from their agency stating that that particular LEO was authorized by his/her department to purchase the non-roster weapon? Is that wrong?

I believe that's the case for CA's named Assault Weapons, like a Colt or Bushmaster AR-15's. Not quite sure about off-roster handguns. You can always call your nearest/favorite FFL.

You are right... that it's wrong.

There is no LEO agency letter requirement for an off list handgun any longer, nor for standard capacity magazines. It's walk in and buy them. The handgun purchase is, however, subject to the 10 day wait unless the agency provides a letter requesting waiver.

An AW purchase requires agency consent.

That used to be true, but no longer. There's a notice someplace on the DOJ web site, but I can't find it just now.

Thanks again folks. I posted a similar question in the LEO section... thanks for answering and not bashing me for two posts.
