Cap guns in CA?

I was thinking about getting my nephew a 12-shot ring cap gun but read on a reseller's website that sales to CA might be prohibited.

Anyone have any definitive info on toy guns? It appears to come with an orange tip.

It's not "definitive" info, but I bought my son a cap gun for Christmas this year off e-Bay. No issues. I bought several 8-shot ring caps as well.

If a cap gun has become prohibited in this state, that just reflects what a sorry state this state is really in.

I was born in 1950 and my brothers and I and our friends used to play with cap guns all the time. As I recall, no one was hurt and no one died.

Ours was a roll of red caps that you put in the gun (can't recall exactly how as that was a really long time ago). We even had "Fanner Fiftys" guns where you just kept on hitting the hammer back with your hand and the caps would go off in succession.

ARTICLE 1. BB DEVICES AND IMITATION FIREARMS
12550. As used in this article, the following definitions apply:
(a) "BB device" is defined in subdivision (g) of Section 12001.
(b) "Firearm" is defined in subdivision (b) of Section 12001.
(c) "Imitation firearm" means any BB device, toy gun, replica of a firearm, or other device that is so substantially similar in coloration and overall appearance to an existing firearm as to lead a reasonable person to perceive that the device is a firearm.

12551. Every person who sells to a minor any BB device is guilty of a misdemeanor.

12552. (a) Every person who furnishes any BB device to any minor... is guilty of a misdemeanor.

I am not particularly surprised that the someone does not want to send a cap pistol the the PRK.

So it appears a "BB" device is a firearm as far as DOJ is concerned.

Think about that the next time you are plinking a few cans in the back yard with your Red Ryder.

In the City of Los Angeles you CAN'T plink at cans in your backyard with a pellet gun -- it is ILLEGAL.

I don't think an orange tip is good enough for Ca law. IIRC, the entire gun needs to be orange or green. There are exceptions for "theatrical" purposes. Sometimes being a re-enactor helps. Anyway, all cap guns are legal to own in Ca but, to sell one it needs to be properly colored or it's a $10,000 per gun fine for the vendor. At least this is why cap guns were scarce at re-enactments for a short time. Luckily, someone found the theatrical exemption and it seems to be working fine.

Just need parent/guardian permission to gift/give/loan a BB gun to a minor.

(a) Every person who furnishes any BB device to any minor, without the express or implied permission of the parent or legal guardian of the minor, is guilty of a misdemeanor.

(1) A loan.
(2) A transfer that does not involve a sale.

Airsoft guns also have just an orange tip - you sure that's not good enough?
