Handgun roster expiration question

I plan on buying a HK USP online and noticed the expiration date on the list is 12/31/09. Say I bought it and there was some kind of delay in shipping. I receive it after 12/31/09 and HK didn't renew the USP on the list. Would I still be able to DROS it since I ordered it before 12/31/09 or does the DROS have to been done before the expiration date. I know there's a lot of ifs involved but I'd hate to buy the gun and then have it sit at an FFL until I found an out of state buyer for it. Thanks for any help.
