I was at a shop recently and one of the guys said that after the beginning of the year new handguns wouldn't be allowed into the state because of the microstamping law. Is this the truth or is it FUD?

Yes, there is a new microstamping law set to go into effect Jan 2010 for new handguns designs that want to be included on the roster, but there was a nice poison pill inserted that will keep it from going into effect.The underlined portion of the bolded section is the key point, there are patents on the technology that would have to be licensed, so until the patent restricitons go bye-bye, no microstamping laws.12126. As used in this chapter, "unsafe handgun" means any pistol, revolver, or other firearm capable of being concealed upon the person, as defined in subdivision (a) of Section 12001, for which any of the following is true:
(b) For a pistol:
(1) It does not have a positive manually operated safety device, as determined by standards relating to imported guns promulgated by the federal Bureau of Alcohol, Tobacco, and Firearms.
(2) It does not meet the firing requirement for handguns pursuant to Section 12127.
(3) It does not meet the drop safety requirement for handguns pursuant to Section 12128.
(4) Commencing January 1, 2006, for a center-fire semiautomatic pistol that is not already listed on the roster pursuant to Section 12131, it does not have either a chamber load indicator, or a magazine disconnect mechanism.
(5) Commencing January 1, 2007, for all center-fire semiautomatic pistols that are not already listed on the roster pursuant to Section 12131, it does not have both a chamber load indicator and if it has a detachable magazine, a magazine disconnect mechanism.
(6) Commencing January 1, 2006, for all rimfire semiautomatic pistols that are not already listed on the roster pursuant to Section 12131, it does not have a magazine disconnect mechanism, if it has a detachable magazine.
(7) Commencing January 1, 2010, for all semiautomatic pistols that are not already listed on the roster pursuant to Section 12131, it is not designed and equipped with a microscopic array of characters that identify the make, model, and serial number of the pistol, etched or otherwise imprinted in two or more places on the interior surface or internal working parts of the pistol, and that are transferred by imprinting on each cartridge case when the firearm is fired, provided that the Department of Justice certifies that the technology used to create the imprint is available to more than one manufacturer unencumbered by any patent restrictions. The Attorney General may also approve a method of equal or greater reliability and effectiveness in identifying the specific serial number of a firearm from spent cartridge casings discharged by that firearm than that which is set forth in this paragraph, to be thereafter required as otherwise set forth by this paragraph where the Attorney General certifies that this new method is also unencumbered by any patent restrictions. Approval by the Attorney General shall include notice of that fact via regulations adopted by the Attorney General for purposes of implementing that method for purposes of this paragraph. The microscopic array of characters required by this section shall not be considered the name of the maker, model, manufacturer's number, or other mark of identification, including any distinguishing number or mark assigned by the Department of Justice, within the meaning of Sections 12090 and 12094.
In any case, existing designs will stay on the Roster even if the microstamping law were to go into effect.Jack

Microstamping is a non -sequitor. Reloaded brass from a range will already have a microstamp on it. If it was fired by a 2010 model gun. Then you with your pre microstamp gun will ruin the microstamped brass or you will also have a 2010 microstamped gun and then it will microstamp over the previous microstamp on the shell thus making the shell impossible to trace. One could pick up a bunch of brass at the shooting range,microstamped brass and non- microstampe brass and "salt" a crime scene if you were a bad guy. Remember folks that this is the same state that outlawed talking on hand held cell phone use while driving but then had to ammend the law to include "texting" while driving. We are on a ship of fools with morons making the laws.Comment

The concept of micro stamping is noble. But, from the stand point of an actual forensic person, there are too many unanswered questions.
1. What if the firing pin double strikes?
2. What if the strike was not strong enough for stamping?
3. What if the cartridge cases were reloaded?
4. What if someone replaces a faulty firing pin?
5. What if someone polishes out the firing pin?

like they wont all start using revolvers too. aside from the whole patent hiccup.....i don't think that it even works!!!!! seriously, how is the case supposed to be stamped? can't be stamped before it gets loaded into the chamber, and it can't get stamped in there either. I've been up and down my guns trying to figure out how they could actually do it and I'm stumped! how are they supposed to put a serial number on the firing pin? and like mentioned before, what if the firing pin is replaced? it's not like that is an uncommon thing to do to a gun! and after 1000 rounds, heck even 500 rounds, do they really think that the serial number will still be readable? I'm utterly speachless that humans of that great of power can be that stupid! I'm completely convinced that the people who wrote this law have absolutely no knowledge of guns whatsoever!!!! and really, what gun makers are going to pour money into R&D to develop something just for the PRK when they can make tons of money elsewhere! just tell the PRK to f*ck off and that it's not possible and then the law is nullified!!! OHHH.....IT HURTS MY HEAD TO THINK ABOUT HOW DUMB THEY ARE!!!!!!!!!sigpic
