    Should I have waited?

I bought a Glock 23 at Turners last Friday and I am now waiting the 10 days. In the meantime, I ordered a bunch of stuff. Stormlake 9mm conversion barrel, range bag, 500 rounds of 9mm, 1,000 rounds of .40s&w, cleaning kit and some defense ammo. Now the question is, should I have waited?

I do have 2 dui's on my criminal record. I know, I was very stupid and have been sober since my second. In anycase, will they deny me the right to own a firearm for these two misdemeanors?

Prior to buying, I felt pretty confident that I was a citizen of good moral character but I'm starting to worry. Thanks for any advice or comfort you can offer.

should have ordered a DOJ Eligibility check first....they take a while, but are basically a pre-clearance for firearms ownership questions...hope everything works out for you....that would be a shame to plunk that kind of $$$ down, only to be denied....but go to the DOJ website and read the list of reasons for denial....a felony is one of them, but it is quite specific....just go to CA DOJ website and look it up...

Well, since the DOJ check is done instantly at the time of DROS, and you are now waiting your ten days, I don't see any problems.

If you are denied, it's usually done right then and there. The ten day wait has nothing to do with the background check. It's a cooling off period in case you bought the gun while you were pissed off at someone and wanted to shoot them.

I just did mine and it took 2 weeks start to finish.

To the OP: One of the most common reasons(from what I've read and been told) a sale is denied is problems with the DMV.

DUI is generally a misdemeanor unless serious bodily injury or death was caused during an accident.
If you have a felony conviction, you would know it.
Maybe you can ask the guys on the FFL Forum what they know.
          Good luck.

If it were a felony the OP would be aware that he would be a felon.

He already stated they were misdemenors

"A first-time DUI, (or, in some states, "DWI" -- short for "driving while intoxicated") is normally charged as a misdemeanor, not a felony. But if someone was injured as a result of the drunken driving, some states will raise the charge to a felony -- and if the victim dies, some of these states will charge the driver with reckless homicide.

Also, in a number of states, a DUI will be raised to a felony if it is the driver's second, third, or even fourth DUI offense."

But does it specifically say CA is one of those states?

For the record, both were misdemeanors. Not all second offense DUI's are felonies in CA.

So will a suspended Driver's license prevent gun ownership?

Not sure which CA law books you are using, but here are what my CA law books say...

Assuming no injury or death -

                      Within a 10 year period:

                      1st DUI - misdemeanor
                      2nd DUI - misdemeanor
                      3rd DUI - misdemeanor

Any dui CAN be a felony. But generally they involve enhancements such as the aforementioned serious bodily injury. But that's not the case here. If I wasn't clear in the post, both are misdemeanors.
