Same issue with sig pro 2340 and sig pro 2022 .357/.40 mags. It can fit 12 rounds of 9mm for the sig pro 2009 and sig pro 2022 9mm pistols.
Legality: may be illegal

I've shot hundreds of rounds of 9mm out of my P229 using a 40-9mm stepdown barrel and the original 40sw mags. I've never tried putting more than 10 rounds in, but I'd imagine that 12 or 13 would go in. That's probably illegal in CA, and probably a little stupid, too.Comment

Obviously, this is illegal in CA: Installing a +2 floor plate on a 10-round Glock magazine to make it 12-round maximum capacity.
Correct?
But is this illegal?: replacing the follower of a 10-round Glock mag with an OEM "9mm3" follower to make it 11-round maximum capacity (but very tight fit).Comment

Maybe, but these probable magazine mods (illegal or legal) are not meant for self defense applications. I'd rather have a reliable 10-round mag than an unproven more-than-10-round-modified mag in a self defense situation.Comment

XD 40 mags hold 15 rounds of 9mm and function. The problem is the slide will lock back with one round in the mag. This is solved by pinching the feedlips together about 20 thousands of an inch. This fixes the problem and the mag will work properly in both 40 cal guns and 9mm. I wouldn't consider this manufacturing a hicap mag because it still works in the 40 cal gun too. I personally have had to do adjustments on mag feedlips on other mags in the past so they would function properly. That said I wouldn't use a forty cal mag with 15 rounds in it for home defense but they sure work well for pistol matches I'm told.

Works for Glocks.
It's not illegal because you are still in posession of a 10 round .40 S&W magazine. Then again I wouldn't use them for defense puproses when you know you'll need to talk to the cops.Comment

Alot of guns have interchangable mags which hold two or more different types of rounds. It's usually between the .40 s&w, .357 sig, and 9mm. Don't fill a .40 cal mag with more than ten rounds of 9mm for sure, regardless of how much more rounds it can hold in the smaller round. That is ILLEGAL! As far as just loading 9mm into a .40 cal mag, am not sure about it's legality, but do "assume" it would not be illegal, again because some mags are purposely made to hold or interchange rounds. Some magazines are exactly the same The followers are what makes the difference in how much you can load into the magazine body.Comment

WHY would it be illegal to use a 40sw or 45gap mag to hold more than ten rounds of 9mm? The law states very clearly that manufacturing, importing, selling, lending or giving high capacity ammunition feeding devices is illegal.
Not "loading" not "owning" not "using" and (surprisingly!) not "buying"
So using a 40 mag to hold 9mil? you haven't imported it, you haven't sold it, you haven't loaned it. And even if you have, it's still a 10 round magazine for 40sw, which is probably how it's marked on the magazine body anyway.
Swapping out a follower to get an 11th round? ILLEGAL. And the same thing with +2 floorplates. But using a magazine, without modifying it, can't even be considered manufacturing. And so what if you bend the lips? maybe you dropped it...maybe it was like that when you bought it. Maybe it's irrelevant, because it doesn't in any way change the number of rounds that fit into the magazine.
Knowing the law, and following it to the LETTER, as opposed to what DOJ says is the "spirit" is why we have OLL today. Keep that in mind.If you're not a resident of California, please don't waste your time trying to sell handguns here. So long as you did NOT do any modifications to the mag itself (swap springs, followers, or attach mag extensions), then you should be in the clear to use the 40 10 round XD mag in the 9mm XD pistols.
If anyone goes this route, I suggest you also purchase a 40 caliber XD pistol as well, so no one will question you why you have a 40 caliber mag when you ONLY have a 9mm Springfield XD pistol? I have seen 40 S&W XD pistols go at very good prices and they are very nice pistols.
Or if you go this route for any pistol.

This works on CZ75b as well. I have some .40 cal mags, and when shooting in Arizona at my dad's I was able to load 14 rounds in them.
While in California, I only load them to 10 rounds. They're Promags, but have been reliable this way.sigpic
