Question Regarding Purchasing on Consignment

I have a question about purchasing a gun that is on consignment. Is it exempt from the 1 in 30 (similar to a private party transfer)?

I bought a new gun at Turners, there was a consignment gun I wanted to add to the DROS and was told I’d have to wait 30 days after new purchase to DROS it.

That employee at Turner’s is not correct. Consignments are PPT’s at Turners, and PPT’s are exempt from the 1-30 rule. How can they be PPT’s if the other party is not present? Answer: Turner’s has all the seller’s info and can process it as so.

I have seen employees question each other in front of customers all the time. They are humans, after all, and don’t know everything. Ca gun law is very complicated.

There’s one thing to note also. Even if they’re wrong, they can always say the words “store policy” and it’s finished, argument over.

It is a limitation on the seller, not the purchaser. Should be a moot point if the gun that the person consigning to the shop is in that person's name in the state's DROS records, but this is California, so...

As long as the consignment came from a CA resident, it is roster exempt and 1/30 exempt

pretty sure that law is not specific to just pawn shops. i have been to many a lgs and saw guns i wanted to purchase that were still in that 30-day window. i think turners has it on their website when the earliest date to start dros on the guns on their used page for this reason.

So if the gun is in the case, and the end of the window is a few days from now, who gets to buy the gun? Whoever makes the deposit first?

Typically whoever pays in full first. Different stores will have different policies

Ya many of the lgs I frequent will let me know what they “have in the back” in the 30-day hold. Then again, I know of many guns, either off roster or something else cool, that never make it to the sales floor because an employee snatched it up.

La city has specific rules regarding this

Some cities (los angeles for example) have their own 30 day law which overlaps with the state 30 day law but does not share the same exemptions.
So without knowing what city you were in, it's not possible to determine if the turners employee is correct or not.

Also, the order that you DROS the guns matters if both DROS are not done correctly.
If you DROS a 1-in-30 gun before another gun, the 2nd one will fail if the 1-in30 exempt DROS is not done correctly.
You need to correctly DROS the exempt one before the non-exempt one.
