My son will transfer a hand gun to me and I know that I have to have FSC and file BOF 4544A form to DOJ within 30 days of the transfer. I don't own any guns. Can I use the gun immediately after filing the form wait for an confirmation from DOJ? I'm curious if DOJ will check my backgroud or not. What else do I need to do? Thanks.

DOJ will check your background but you can use the gun right away. If you plan to use it on CCW however, you may have to wait for the form to be processed.
In either case I suggest that you file the form ONLINE so you have a paper trail.

He can even send you an off roster handgun but not an AW. Federal law requires that all interstate transfers - long or handgun - go through an FFL. The CA FFL still handles it as an interfamily transfer you just have to wait the 10 days and pay the FFL his fees. He can purchase you a gun as a gift but you can't offer to give him the money or pay for it (straw purchase).Comment

You can not take possession of a gun in a state where you are not a resident - federal law. You can purchase out of state but it must be delivered to you in your state of residence by an FFL.Comment

No, that does not work.
If it's a handgun, fed law is quite clear the transfer must occur in the state of residence of the receiver.
If it's a long gun, feds are OK with transfer at any old FFL, but only if that is OK under the state laws of buyer and seller - it is NOT OK with CA, so for CA residents, still must use a CA FFL.

Closed - this is a CA law question, not a handgun question, and so this is the wrong forum. Moving it to the right forum would just create an unneeded dupe.Last edited by Librarian; 02-24-2021, 9:29 PM.ARCHIVED Calguns Foundation Wiki here: http://web.archive.org/web/201908310...itle=Main_Page
Frozen in 2015, it is falling out of date and I can no longer edit the content. But much of it is still good!Comment
