    S&W 659 - Transfer Question

    Hi all, I'm new to the site and have a quick question for you.

    I'm a California resident, and may have just received a S&W 659 semi auto from my grandpa. It has a 14 round capacity, so I'm not sure if I can report it on a "Report of Operation of Law or Intra-Familial Hangun Transaction" because it's 10+.

    Any help you could offer is appreciated.

    If both you and your grandfater are CA residents, then your grandfather gives you the handgun and within 30 days you send in a Report of Operation of Law or Intra-Familial Handgun Transaction Report with $19 to CA DOJ BOF.

    If your grandfather is not a CA resident, then he needs to send the handgun without any magazines to a CA FFL dealer and you need to DROS it. Since, it is an intra-familial gift, it is exempt from the approved list.

    Your grandfather can not give you any large capacity magazines.
    However, he can give you magazine parts, which you can keep and never assemble them to make a large capacity magazine while in CA or assemble them to make a permanent 10 round magazine.
    Factory 10 round magazines can also be aquired for use in a S&W Model 659.

      We are both california residents. So I guess I'll just have to get a 10 round magazine.

        Is a Handgun Safety Certificate required for a Report of Operation of Law or Intra-Familial Hangun Transaction?

          Yes, although the OP-Law form never asks for it, the Penal Code does require it. If you do not already have one, get one.
