    High cap mag question

I have a question for you experts. I'm a sworn peace officer but my department doesn't authorize us to carry on duty (probation). What is the requirment for purchasing high cap mags. By case law I can carry off duty beacuse I'm a sworn officer. thanks

Used to be the dept letterhead, but now you just need your dept ID if the vendor is willing to sell.

topgun hit it on the head.

Current LEO ID is enough to purchase. Federal law allows you to carry off duty.

Federal laws may allow you to carry but, don't do something that your superiors will consider insubordination! Your pension is too important!

As a Probation Officer you could possibly encounter dangerous felons on the street that have been sent to jail previously based on your recommendations to the judge. In this circumstance, I would say your life is far more important than your pension. The union will most likely side with you to keep your job in an instance where you have to discharge your firearm in self defense.

Just out of curiosity, why would ANY department prevent ANY LEO from carrying?

Probably the same reason the legislature prevents normal citizens from carrying: the age-old, untruthful, cr*p reason... Liability

The fate of the wounded rest in the hands of the ones who apply the first dressing.

+1. Go to your local Sheriff and request a CCW. This will cover you both ways.

AFAIK, we are under the same exemption.

I don't think so. My dad is retired from a federal agency after +30 years and AFAIK, he isn't able to purchase or import +10 round mags any more.

I believe retired feds aren't automatically covered for carry, I think they have to request a CCW thru their local sheriff.

For that matter, I have a number of retired cop friends and their carry status depends on the agency. One, from San Benito county, didn't get squat when he retired and had to get a CCW when he moved to Fresno. Another has to qualify, day and night fire, every quarter. Yet another was just handed a retired ID with endorsement to carry and was told to have a nice rest of your life.

As for the OP, my guess is anybody with Cop credentials, retired or otherwise, can purchase standard (high) capacity mags. Another poorly written PRK edict.

CCW and ability to buy +10 round mags are not the same thing! You are right in the fact that he must apply for a CCW but, the Patriot Act also states that he has the RIGHT to get a CCW! Now, if only the San Mateo Sherriff's Dept. would follow the law, he would have one. They have refused to issue him a CCW in violation of federal law!

If his department doesn't approve of him carrying on his LEO ID, they won't approve of him carrying with a civilian CCW either. Fact of the matter is, as a current sworn LEO, you do not need a CCW and it changes nothing regarding the attitude of the department.

That's not right. San Mateo Sherrif is a rogue org.
