I found this, dope article! Bump if you guys want

Building an AR Pistol is a fairly simple process, but there are a few things you should be aware of before getting yours assembled. This article on ITS covers some of the legal aspects of building and owning an AR Pistol.

bro you need to slow down. a lot. that is federal rules. short-barreled rifles are flat illegal in CA, Form 1 or not. Even the feds would reject your Form 1 application because you live in CA. A semi AR pistol you just made is a "gray area" meaning that simply having it could very well be arrested and charged with a felony. Or you are fine. Nobody knows for sure, that's why it's gray. It all depends on how the local cops/DA interpret the definition of "manufacturing" in the law, and your lawyer's ability to convince a judge the other way. Good luck. And nobody's mentioned the new marking law! You have to engrave and register that pistol before july, or if you wait you can apply for a serial number to apply and register after. That'll cost you a background check, a form you have to sign with details where you may or may not have to admit to possibly commiting said felony (or just lie on the form, which is a different felony!)

Ok guy. I got one for ya.

I know someone who may have a Kaiser Defense KR5 5.56 that was Fed 4473 in NV from a FFL as "other" Not Pistol, or Rifle, but "OTHER" meaning striped.
Later that person moved to CA and while in CA completed a pistol build. At that time (sometime in 2008 I believe) there was no vol reg requirement on pistol builds.
Can this guy I know now go in to CFARS/CRIS and reg his pistol as a AW? Since it's a legit manufacturer there is no 80% issue what so ever. Would he need to first register the KD lower as a pistol then an AW? or both at once?

            Before 2014...
When the person moved to CA and became a CA resident, that person had 60 days to register all the handguns they brought with them to CA. This includes "handgun" receviers.

If that person did not register the receiver as a handgun back when they moved to CA in 2008, then it could be seen as a SBR (weapon made from a rifle) and not a handgun.

Even if it's just a striped receiver, with to plans or intentions on if it were to be built to pistol or rifle?

What year did the DOJ/BOF require reg of California home built pistols from striped lowers? (not 80%ers but actual brand OLL's)

Humm. I wonder. If said received entered the state in 08. and was later built in to a pistol, if the 60 day window starts at the build date. interesting.

Not to question you at all here. Just having a dialogue. but I believe during those times of pistol build madness (Obama's first term) they changed the Federal 4473 to include the term "other" when buying striped lowers because of the striped lower could be builtd in to ether (in CA single shot) pistol or rifle.

                I remember the build parties.

IIRC at that time it was concluded here in calguns that lowers 4473'd as "other" and brought in to CA for new residents could be California built in to ether a rifle or pistol, and since the lower was not DROSED it was recommended (BUT NOT REQUIRED) to vol reg it as a pistol in CA just to ensure no confusion. I remember some even having PISTOL engraved on their lower just in help with any LEO confusion.

Does anyone remember this? or am I mistaken. I am getting old. lol.

in 2008 someone moving into CA had to "new resident" register any handguns brought into state. Not true for rifles at the time. And CA does not recognize "other". So when they moved to CA it was immediately either a handgun or a rifle. If they didn't register it as a handgun, CA would say it must then be a rifle. If you try to AW as a pistol now, they'll say "that isn't a pistol, because it isn't registered as such, so that makes it a SBR". I supposed they could new resident register now, with a 2008 date (for which there's no penalty), then AW register.
