    AR PISTOL CA, PPT IS ILLEGAL????!!!!

    I am being told by an FFL in my area that PPT of factory serialized, pre ban AR pistol is illegal and that I cannot own one. My neighbor has one that I would really like to purchase. Please advise!!!!

    I have something of a similar question. PSA is selling short barreled complete uppers w/ CH and BCG included for a pretty rad price right now. I know if it's not attached to a lower it's not considered an SBR, however if I do attach a lower but it doesn't have a buttstock it's just a pistol so I'm good to go?

      No. The lower you attach it to must be a previously designated AR pistol lower.

          Like oceanbob said. Once a lower goes rifle, it can't go back.

          Also worth noting is that you should research constructive possession as it regards to SBR's and federal law.

          It is not a good idea to possess a short barreled upper if you don't also have a pistol lower and are able to construct it legally. Likewise if you have an illegal configuration but it is NOT Assembled, you can still be charged with constructive possession of an SBR.

          Research this and don't do it.

              You can PPT a factory AR pistol that is not in AW configuration as per the new SB 880.

                It has to be DRO'ed as a pistol or AOW. Once its a rifle it cant go back down. OP I would suggest seeing another FFL. The laws are so muddy the sun cant even see threw them.

                  Starting 01-01-2017, a semi-auto pistol with a "bullet button" style magazine lock that accepts magazines outside of the pistol's grip is an assault weapon. [PC 30515(a)(4)(D)]

                  It is illegal (felony) to advertise for sale or transfer an assault weapon. [PC 30600(a)]

                  In order to legally be able to advertise for sale or transfer an AR style pistol in CA, it must be in a CA legal configuration.

                  Here are some CA legal configurations for an AR style pistol:
                  A. Semi-auto pistol with a fixed 10 or less round magazine.
                  ^The magazine needs to be contained in the firearm and can not be removed without disassembling the firearm's action or the magazine needs to be permanently attached to the firearm's magazine well.
                  B. Manaully operated pistol.
                  ^The gas tube/piston is removed and the gas block is plugged. This will make the firearm a manually operated (straight pull bolt-action).
                  C. Disassembled parts.
                  ^Firearm is disassembled into parts and never assembled while in CA. Only the receiver is transferred through a FFL, while the rest of the parts can go direct to the seller.


                  Summary:
                  PPT of semi-auto AR pistol with "bullet button" = illegal [PC 30600(a)]
                  PPT of semi-auto AR pistol with fixed 10 round magazine = legal
                  PPT of manually operated AR pistol = legal
                  PPT of AR pistol receiver = legal

                    *Unattached AR upper with a less than 16" barrel + no firearm that can use it = legal
                    *Unattached AR upper with a less than 16" barrel + handgun that can use it = legal
                    *Unattached AR upper with a less than 16" barrel + rifle that can use it = illegal SBR [PC 17170(e)]
                    *Unattached AR upper with a less than 16" barrel + handgun and rifle that can use it = legal

                    *Attaching AR upper with a less than 16" barrel to an AR lower that was DROS'd as a long gun = illegal SBR [PC 17170(c)]

                    *Making a semi-auto pistol that accept detachable magazines, by attaching AR upper with a less than 16" barrel that has an operational semi-auto system to a AR lower that was DROS'd as a handgun or made from an 80% = illegal assault weapon [PC 30600(a)] and unsafe handgun [PC 32000(a)]
                    *Making a semi-auto pistol with a fixed magazine, by attaching AR upper with a less than 16" barrel that has an operational semi-auto system to a AR lower that was DROS'd as a handgun or made from an 80% = illegal unsafe handgun [PC 32000(a)]
                    *Making a dimensionally compliant bolt-action single-shot pistol or dimensionally compliant break-top/open single-shot pistol, by attaching AR upper with a less than 16" barrel that has no operational semi-auto system (no gas tube/piston installed and gas block plugged) to a AR lower that was DROS'd as a handgun or made from an 80% = legal [PC 32100(b)]

                      AR pistol is AW now. there is no featureless AR/AK pistol

                      you need to make it single shot, bolt action/break top.

                      after you buy it, you can not modify it into a semi-auto.

                      i see there is someone selling MPX for 5000 dollars. what a joke

                              check post #9. you can have a non-aw configuration by using a "fixed" magazine (e.g. AR Maglock, Bullet Button reloaded....etc.).
