A new buyer goes into a FFL to buy a pistol

It's not in stock but the dealer says they'll order it

Twelve days later the buyer gets the phone call pistol has arrived

Buyer looks at pistol knowing manufacturer fires "at least once" but it seems to buyer that the exposed area of barrel at the ejection port is "dirtier" than it should be...the rest of the pistol looks perfect...mags followers are spotless

DROS is submitted and 10 day starts, but buyer wants to know...

Is it possible for a dealer to sell a used pistol as new?
Could a dealer sell a "safe queen" on consignment as if it were new and the purchaser not know? Or is there a "check and balance" in the submitted paperwork that prevents this from happening...and if so, what is it?

What I can tell you but probably isn't answering your question is that anything is possible.....If it appears to be new and looks new and I really wanted the pistol I wouldn't argue too much if the price was right. I do agree that if one is advertised as new it should be just that.

I believe when you buy used you get slightly different paperwork. I only bought a lower that was on consignment years ago though so I don't really remember what exactly was different but I believe I got an extra paper with my dros.

i always wondered if my Beretta Cougar was really NIB when i bought it

the gun had been out of production for years, then, suddenly a broker had several in stock - they are fairly reputable as far as i know, so i took it at face value it was really new

when i got it home i couldn't see anything to make me believe otherwise, and, believe me, i looked - i stripped it down and used a magnifying glass to go over it - no visible signs of any burnt powder or residue from use - looked as good as any other gun i bought NIB

Years ago I bought a Marlin Model 25 from a local gun shop. It was in the rack on the wall behind the counter. It was sold as new, never out of the store. Now I realize that it was not an expensive .22 rifle, but it was for the use of my youngest Grandson, so it was if nothing else suppose to be "NIB". I was assured that everything that was supposed to be in the box would be there on pick up day. Pickup day comes and when it is presented to me, the box is all taped up and it look's like its been through a lot of hands. I insist on a S/N check and I thought the Sales Person was going to have a Heart Attack. It seemed that the previous three day weekend.....everybody went to the river and so did the Model 25. Needless to say by the time I was done with them, Instead of the $80, I paid for it, I got $40 back and a brick of .22. So Its could have happened, and been Ultrasonic Cleaned.....I would look it over very carefully.

Of course. Just like a used car salesman can sell you a car that was not, in fact, previously owned by a little old lady who only drove it to church. Caveat Emptor.

Did the manufacturer themselves state "at least once"? I'd think the maker would be able to tell you whether or not they put a magazine or twenty through a gun.

I imagine the required paper trail would tell the tale, but I don't know how you would be able to look at that. There was a poster a while back who bought a used Glock from a forum member who told him he was the original owner, low round count, etc. When the buyer went to register it on his carry permit, the officer said something like "Wow, this thing has been around." Turned it had like seven previous owners.

That's the special break in package....I imagine that was extra. It's to ensure everything is running extra smooth by time you get it

and then there's the possibiulity that the dealer wanted to try it out and put 100 rds thru it and then put it back into the box after a cursory cleaning

A consignment is run as a PPT once a buyer is lined up, so technically it could not be sold "new" as a consignment. You'd have PPT paperwork.

When a dealer is running a sale out of their inventory, the only difference on the DROS form between a new or used gun is the "New/Used" box. So yes, a dealer could take into inventory a used firearm, misrepresent it as new to a customer, and intentionally check the wrong option for the "New/Used" question on the DROS form.

Register it on your CCW - When the sheriffs run it, ask him how many owners its had. It tells them when they run the serial #.
