why cant the sp01 be on the list in 40s&w

I don't know, maybe get a CZ75B in .40 or a TS in .40 if you want to get close as possible to the one you want.

It's not on the list because CZ didn't have it tested.

If I remember correctly, the SP01 wasn't available in .40 before the requirement for the magazine disconnect or loaded chamber indicator kicked in, of which the SP01 has neither.
