Son moving back to CA -

My son has been going to school out of state - thankfully, he's completed that portion of his journey and will be moving back soon - my question is this - he picked up a handgun while out of state, I know he'll have to tell big brother about the firearm - the mags are std capacity - does he have to get 10 rounders?

Yes, your son will need 10 round mags, also I would buy some off roster glocks or HK VP9 and register here once he's coming back

Yes 10+ mags cannot be imported into CA, and grandfathered mags will soon go away.
You can also convert 10+ mags by installing mag blocks and making it permanent using epoxy or rivets.

Even though rivets can be removed by drilling them out (and committing state felony), this is considered permanent under current law.

Yup, as mentioned above, just convert the mags to permanent 10 rounders, and ensure he self reports the importation of the handgun within the required time limit after arriving here.

If he plans on telling the world that he has mags that hold more than 10 rounds and coming to cali, then yes don't bring them. Aside from that just keep it on the low and let him do as he pleases.

Did your son retain California residency, as defined in PC 17000, while away at school?

It makes a significant difference in terms of what he must do, and how he must import the weapon into California.

Your son's gun collection will help settle him back if he decides he doesn't want them anymore.

Legion Sigs, MOS Glocks, SA 9mm RO, HK P7's, etc.

Did your son become a resident of the state where going to school? Probably necessary to purchase firearms there.

My daughter has been in Alabama for 10 years and is finally coming back to CA. She has a few firearms she'll be returning with .

Please expand on this. If he kept his ca resident. How can the person purchase a gun elsewhere? Also, is there special exceptions if a child goes to an academy because he is considered in the military? He still has ca drivers license though.

The federal and California state definitions of "Resident" are quite different form each other. This point alone throws a whole lot of people. California considers you a resident if you keep a home here and intend to return when absent (refer to Penal Code section 17000). Federally you have to be present within a state to be a resident of that state (with one exception made for military folks who commute daily across a state line). Feds define a military member as being of resident of the state they are assigned within on PCS orders (Refer to 18 USC 921).

To purchase a handgun you have to be a resident (by federal definition) of the state where the transaction occurs.

It's quite easy to be a California resident (under California law) and be a resident of a different state under federal law. A good example is a young military member, who keeps a room in his parent's California home, keeps his California Driver's License and is assigned on PCS orders to Fort Lewis. California would consider him a California resident because he keeps a California home and the retention of the DL would indicate an intention to return. The feds would consider him a Washington resident since he has PCS orders to a Washington state base.

The difference becomes quite significant when returning to California with weapons acquired out a state. If California considers the subject a Californa resident (and irrespective of his federal resident status), then the imported weapons are subject to the Penal Code section 27585 process (the weapons have to be shipped to a California FFL for transfer and be on roster). If a subject comes into California as a new resident, then the importation is controlled by Penal Code section 27560 (they can transport the weapons in, handguns need to be legally configured, but don't have to be on the roster. Report is made to DOJ via a self-reported form and $19.00 fee).
