    Advice or thoughts on my off roster purchase

    I purchased an off roster 1911 without knowing it was off roster, I walked into my lgs and saw a RIA 1911 and purchased it on the spot in May 2015. The first time I took the pistol to the range the frame broke, here is the problem. The manufacture was good to work with and replaced the pistol, when the did they caught that it was off roster and sent an on roster version. The new one is a stripped down gi, the original was had upgraded sights, grips, trigger, and hammer so I now have a pistol that retails for $150-200 less than what I paid for. The lgs is not wanting to hear anything about this and giving me the run around.
    How would you handle this?

    my thought is that you resolved the matter with the manufacturer at terms that you agreed to. i don't see that it is appropriate for you to go to the lgs/seller and try to renegotiate a better resolution to a matter that has already been settled.

        IFAIK, no product from Rock Island Armory has been on the roster, so the 1911 that you purchased had to have been used at the time of the sale (consignment or otherwise).

        It seems to me that the burden falls primarily on the manufacturer. I would contact RIA, explain the situation, and see if they'll make things right. IMO, the gunshop doesn't really bear any responsibility here, unless the frame was cracked when you bought it from them - and you can prove that.

          The pistol was new when I purchased it, Rock Island does have pistols on the roster. My first concern was with the risk of having an off roster pistol that was purchased NEW after SSE was gone, the manufacture did what they could with replacing the pistol and the terms I agreed to were this is what we can give you or you can keep the broken gun. There isn't much of a choice there, I am not looking to get something for nothing I am just a little upset that I have had to DROS a pistol twice and paid for the upgraded unit and now have the entry level.

            Yes, your situation does suck. How long after you purchased it did you notice that the frame had cracked, and how many rounds had you fired through it?

              And which model was the handgun in question (the one that you originally bought)?

              According to this, no Armscorp handgun has ever been de-listed:



              If that is true, if your first handgun was on the roster when you bought it, then it is still on the roster.

                So what does the LGS have to do with any of this? You should have asked if they could send you the upgraded sights, grips, trigger, and hammer to install on your new on-roster pistol

                  It was off roster when I purchased it (I didn't know that then) I don't have the model number handy. The pistol broke the first trip out 6 rounds fired! 3 days after purchase.

                    I don't believe that a LGS can sell you an off-roster brand new gun?

                      Not their fault the the state we live in sucks. Just be happy you got a new pistol. This is why they are all pulling out of Cali

                        Hmmm.

                        OK, there's some things that are hinky here. The first is that a gunshop could NOT legally have sold you a new handgun that was off roster, unless it was a consignment gun (or you're a LEO).

                        If it was a consignment gun, then you have no way of knowing if it had been fired or not before you bought it.

                          if you bought it in 2015, it couldn't have been SSE'ed to you. that ended 12/31/14. perhaps it was a used/cosignment gun that that was sold to you?

                          if not, it shouldn't have been off-roster unless the FFL screwed up and accidently sold an off-roster gun under an on-roster listing.

                          look up the model that you did buy so we have more info.

                            Secondly, seeing as no Armscorp/RIA handgun has fallen off the roster, it must have never been on the roster. This would further support that the handgun was used, possibly a LEO's gun.

                            If, on the other hand, you're misinformed and it actually was a model that was (and still is) on the roster, the manufacturer would be obligated to return the same model to you.

                            You need to find out exactly what model you purchased in 2015.
