    Transporting Handgun

    When transporting a handgun what does the CA "law" say is the 100% legal way to do it?

    I don't want to here you must legally separate the ammo, or you must stick it in your trunk.. I want to see the law since many vehicles don't have trunks or a way to separate the two.

      I realize that 'search' inside this software has some limitations, but did you even try?

      The law is in PC 12026.1 and PC 12026.2. Search for that.

        I think part of the issue may be that most of the threads that come up when you search are threads where most of the responses were to "use the search"

        Maybe a cleanup is in order of all the duplicate handgun transport/hicap magazine/whats a OLL/when will Obama take my guns away threads.

              The CA PC with all of the gun laws and the associated Regulations are on the CA DOJ Bureau of firearms website. The Calguns.net front page has a link on it to the BOF page. There is also a sumary booklet of the laws on there.

              If you are new to reading and understanding (if possible) the penal code ins and outs, there is also a book avail. at a lot of gun shops called: How to own a gun and stay out of jail in CA. It is written by a CA attorney.

              Searching on hear will only get you a bunch of opiniions, and you will have to sort out what is fact, fiction, and FUD. After researching on your own, you will probably have some questions, but will be able to ask a detiled question and hopefully get an accurate answer.

              With the collection of wacky gun laws we have, everyone who owns a gun should be familiar with those laws and where to find and research them for their own protection.

                Maybe this is what I don't get.


                "On the passenger seat next to a driver in a car, clearly visible, is 'open transport'. "

                Yet the code for transporting a pistol or firearm which is concealable says.

                "The firearm is within a motor vehicle and it is locked in the
                vehicle's trunk or in a locked container in the vehicle other than
                the utility or glove compartment."

                No where in the penal code do I see anything about "OPEN TRANSPORT".

                      There is not a law that allows open carry there is simply not a law that makes it illegal

                      I recommend transporting in a locked case while in California due to the high likely hood of being hassled as most cops don't realize its legal to open carry an unloaded handgun in the vehicle

There is no penal code mentioning open carry thus the question... no offense but anyone can write something on the web and claim it law.. thus the reason I was looking for a penal code that mentioned open carry in a vehicle was legal. All I see is mention of when transporting in a vehicle it must be in a lock box.

                        I`m not trying to argue just make sure I understand to the fullest.

                          There is no penal code because there is not one
                          they can only make things illegal by passing laws not the other way around

                          OPEN handgun transport

                          Open merely means 'not concealed'. In a holster on one's belt, carefully kept away from outer garments or shirts which may cover the handgun, is 'open carry'. On the passenger seat next to a driver in a car, clearly visible, is 'open transport'.

                          While legal, open transport is uncommon. Because this is uncommon, when transporting openly any interaction with law enforcement personnel could be uncomfortable.
