Constructive intent

I am planning on acquiring an AR pistol lower soon and I had a question about Constructive Intent.

Is it considered constructive intent if I have a pistol upper but do not own a DI BCG. My current AR is gas piston so my BCGs are not compatible.

I'm asking because pistol uppers seem to sell out quickly and I would like to get the one I want and not have to wait for it to be in stock after I get the pistol lower.

Thanks in advance. I looked around but couldn't find anything.

If you are talking about Federal "constructive possession", yes, you need to have a lower which has never been configured as a rifle prior to possessing a short barrel if you also own a rifle which could use the same barrel.

Intent has nothing to do with "constructive possession".

Feds has constructive possession for NFA firearms.

CA has constructive possession for machine guns, silencers, short barrel rifles, and short barrel shotguns.

In your scenario you could have trouble.

Buy or build the pistol upper & keep it off the premises where the rifle builds are until you get a pistol lower.

The "good" thing is once you have that pistol lower you could have 50 pistol uppers for it.
