2nd background check after 30 days?

It's day 33 now. On day 30 I went to turners to hopefully pick up my xd or get a refund. They said after 30 days if still undetermined they start a second background check that should take 3 days. I went in today and they said im still undetermined and they don't know why I was told come today. They didn't exactly want to give me my money back and said they haven't heard anything from doj. They said they should hear something soon and would be surprised if nothing by the end of week. Does any of this make sense? My contract says 30 days undetermined get money back. Anyone else been through this. I'd like my money so I can start the process over w an ffl that will release to undetermined. I'm not prohibited, so I don't get it. Just curious if anyone else has any thoughts.

They should give your money back and get your money back if that is what really want.

As for DOJ delay...I think few calgunner members are going through same thing as well. I think they are just overwhelmed right now.

Well I want the gun but i don't see my status changing from undetermined. I know turners won't release but others will, so I guess I'm tired of waiting

if CADOJ says that you are undetermined after 30-days, they are supposed to issue you a new background check number so that Turners can write that down on the 4473 and release it to you. how that exact process works with the new control number being ssued., I dont' recall.

I would first make sure what you want to buy is actually in stock where you intend to purchase.

Looking to buy an xd9. Waited 2 weeks for turners to get it so this had been a long process. I will go through a home ffl who I believe has it.

Many FFLs are reporting that the DOJ is no longer automatically providing these numbers after undetermined, the FFL must call to get it.

Ok I will go back in tomorrow and speak w a manager. I really didn't want to argue. I've been running on 2 hours of sleep so I just wanted to get home.

Believe me, Turners wants to sell you the gun, and guns to others too, so that means staying in business, and that means staying within the complicated laws.

Be patient... If you are clear, a response will go through in time. Probably will be faster to stay with Turners than to start over somewhere else and have that check delayed due to possible mixup related to two handgun checks in 30 days.

Also, check your agreement carefully about what happens if a background check does not clear.

Point 3 clearly states refund. It's my understanding that turners has the option to release or not. He said they changed their policy 4 months ago to no longer release. He said undetermined means that they have no reason to deny and no reason to approve. 2nd amendment should be reason enough. In my mind turners does not support the second amendment and I will no longer do any business there. It's a bad policy for them. At this point since 30 days has come and gone if gladly give the money to some one else and start the 30 day wait again. Or hopefully this time it works out in 10. From now on I'll ask what the ffl' policy on undetermined is. That was my fault.

I was undermined on my first purchase. Luckily it was from a LGS that I do business with outside of firearms and he releases to undetermined.

I'm guessing that you probably have an arrest record. If you do it is probably incomplete.

You don't want to get the standard firearms eligibility check (they charge for that because you're an evil gun buyer).

What you want to do is get a live scan for the purpose of checking your record for "accuracy and completion". Once you do that you can find the incomplete record and track down the document you need to send to the DOJ for them to complete your record.

I made my 2nd purchase with a delay that was release on day 28.

My 3rd (and most recent) purchase was not flagged at all and released after the standard 10 days.

OP: I would recommend that you don't use Turners for anything firearm related, ever again. They are more of a sporting goods store that sells guns rather than a gun store that sells some sporting goods.

Stick to good, quality FFLs and things like this will be resolved quickly, either via a refund or an answer from the DOJ. I had a DMV issue on my first DROS many years ago and it was taken care of within 24 hours.
