Can I transfer my Beretta 92D to my son?

    Can I transfer my Beretta 92D to my son?

    The question is this.... I'm in Illinois, my son is in Huntington Beach. If I replace the highcaps with 10 rounders can I send this Beretta 92D to Ca. FFL and transfer it to my son as used weapon?

    Yes, but it must go through a California FFL.

      Thanks, I was concerned the 92D might be a problem because it's a decocker without a manual safety.

        Wrong! Only works when both people are in the same state. Otherwise has to go through a FFL.

          I thought any interstate transfer needs to go through a FFL. Handguns need a FFL on both ends, the intra-family transfer means the pistol is void of a "safe" list requirement.

            There are plenty of threads on this, but basically the CA DOJ has special exemptions for Califorina inter-family residents, but the ATF does not, and thus it is illegal to send a gun across state lines unless you use an FFL. If you send it directly, you won't break state law, just federal law.

              That instruction is not on the CADOJ site because it is not a CA law you violated. You violated Federal law by transferring a firearm between two unlicensed individuals from separate states without an FFL involved.

              CA does not care about that, and will tell you that they don't care if you do it and that to satisfy CA law you only have to file the intrafamily/op-law form. But that does not satisfy federal law.
