    Kel-Tec p32 in CA

    so i moved down here from oregon a few years back and one of my firearms is not on the roster of handguns certified for sale, my kel-tec p32. i love this lil pocket gun but what's the point of having it if i can't take it anywhere. it's not a home defense weapon. what options do i have besides stashing it away in the back of my safe? can i sell it? trade it? thanks

    If you legally imported the gun by bringing it with you when you moved here, you can still legally sell it via private party transfer even though it's off roster. You'll have to meet your buyer at an FFL to conduct the PPT process.

      Doesn't need to be on roster. Take it out and shoot it. Totally legal to have, own, use, or sell. Sell it it to me if you want. Roster only applies to buying guns from FFL. Does not affect owning or use. PPT is roster exempt.

        Not sure of the timing but don't the guns brought in from out of state have to be registered?

          It's not illegal for you to use or sell. The roster applies only to handguns sold as new from an FFL. If you wanted to sell your gun to another party, you would do it at an FFL as a private party transfer.

            wow, that is totally not what the guy from my local gun store said. i was told it was a felony just to possess it and i would have to go back up to oregon with it if i wanted to sell it.

                My experience has been that most gun store commandos are ignorant of the law. I have purchased several off roster guns including a Beretta 84BB off a guy that moved here from AZ a year ago and had no issues getting it registered. You need to go to another FFL. Where are you located? I'm sure members here can point you to a reputable FFL. Members here buy and sell off roster guns from private parties all the time, it's a non-issue.

                  100% legal to own and sell in CA.
                  I have one (not for sale).

                  You might want to hang onto it a bit longer.
                  There is a current Shall-Issue CCW permit lawsuit in process now.

                    i'm just outside mariposa. about an hour up into the mtns from fresno and merced. yeah i generally try to take what people trying to sell something say with a grain of salt but he was adamant about it so i thought i'd better check. is there any written proof of this in the doj bylaws and such? thanks

                      I'd post your questions here. You can probably find an FFL in your area there to handle any transfers as well.

                        There is nothing in writing that bans or makes the P32 illegal.
                        In general, there are three categories of handguns.
                        Curio and Relic (C&R)...guns older than 50 years.
                        Off-Roster...guns that are not currently on the CA Handgun Roster.
                        On Roster...guns that are currently on the Roster.

                        C&R guns are often bought and sold by a different process between C&R dealers / collectors, none of which applies here.

                        Off Roster guns are all those from before there was a Roster (like my P32) or guns that have fallen off the Roster.
                        Off Roster guns can only be sold or traded in a face to face transaction, which must be done at a FFL dealer (buyer and seller have to physically be there).
                        An Off Roster gun cannot be shipped to the buyer's FFL dealer.

                        On Roster guns can be sold and shipped from one FFL dealer to another.
                        You do not have to physically meet the buyer / seller in this situation.

                        Check the CA DOJ website for Roster information and the laws.

                        (You may be in a shall issue county, you might be able to get a CA CCW where you live. Check it out.)

                          It would seem Mariposa County is one of the good California Counties and are reasonable about concealed carry permits. You should apply for a carry permit and carry your kel-tec p32.
