Hi, My Dad who lives in Texas wants to sell me his Glock 42 since he did not like it after he bought it. Can I legally buy it from him and bring it to California?

No, your dad cannot sell the pistol to you. The G42 is an off roster pistol so both parties have to be California residents.Last edited by iluvmycolt; 12-14-2015, 11:33 AM. -

He cannot sell it to you, but he can gift it to you. The process is find a CA FFL that will do non-rostered interstate intra-familial gift transfers (not all understand the law) and ask if it has to be shipped via FFL or not. Most CA FFLs that accept this kind of transfer require the gun be shipped via FFL. After finding said CA FFL, find a TX FFL familiar with the said laws. Then have your dad fill out required paperwork (some CA FFLs require a gift letter so ask). After its shipped you receive the gun via similar process to any other handgun (DROS, 10 day wait, etc).

He can bring it to CA and give it to you. Print the forms out online and Mail directly to the CA DOJ BOF. Pay the fee and be done.Comment

No he can not. This has been illegal since the Gun Control Act of 1968 and will earn the dad a 5-year stint in the federal pen. He can bring it here AND TAKE IT TO A FFL FOR TRANSFER. But he can not give it to him straight up. That is only legal if the dad and son are both CA residents.
