Original post did not say that when I asked the question. If you look, OP edited it to reflect that after I asked. Also, it would be illegal for someone to give money to someone else with the intent of the other person to buy them a firearm.
Right on the ATF Form 4473, question 11a:
a. Are you the actual buyer of the firearm(s) listed on this form? Warning: You are not the actual buyer if you are acquiring
the firearm(s) on behalf of another person. If you are not the actual buyer, the dealer cannot transfer the firearm(s) to
you.
If he were to buy the gun FOR his brother as a gift, I think that would be perfectly legal.Comment
