    Gun selling question...

    Quick question because I want to be sure of the answer and I've heard conflicting things....

    I have a handgun for sale. The buyer is way out of town for me, BUT my best friend will be in the buyers town next weekend.

    Can my best friend take my Glock to the FFL and sell it to the buyer? My best friend of course has his handgun permit and conceal carry permit so he is a legal gun owner himself.

    I don't see why my friend can't do this for me? Last time I did a person to person at an FFL all they asked for was my handgun permit and never asked for any proof I actually had the firearm under my name (like my transfer papers, etc.).

    I would save me a TON of time and hassle if my friend can just do it for me.

      Ok, so you're saying I'd have to sell it to him, then him sell it to the buyer.

        Yes ppt twice... you sell it to his friend and 10 day waiting period. Afterwards he goes back to other Friend and do the whole 10 day waiting period again.

          Yeah, you got it backwards but I get the idea. That just sucks, oh well.

            Really, I do not know, but I am more on the agreement that a person may sell a gun that is not registered to them.

            Just be real sure new buyer can pass background or that is going to case a triangle mess. And be real sure the serial number is will not come up flagged or any reason.

              You also can't buy a gun to expressly sell it. Just find a place closer to yourself, or make him pay gas or something.

                Yeah, that part could be a mess - see Abramski.

                There's a difference between

                -- what you can get away with, based on what is checked

                and

                -- doing things the Right Way.

                As noted, in a PPT the seller is not checked (unless the sale cannot go through - then they get a background check, so the gun might be returned). This is because lots of guns simply are unknown to the state, so a check might bring back nothing.

                But If A owns a thing, B cannot reasonably sell it without permission from A. In the case of firearms, that permission probably should be a formal power of attorney.

                Line up all the ducks. Dot all the 'i's, cross all the 't's. California is a real nightmare for gun laws.
