    Arrested as a minor for shoplifting, am I DQ'd for CCW

    I shoplifted when I was 17 and got arrested for it. It was over a decade ago. My only other issue is a red light violation on my bicycle at age 22.

    My record was sealed and expunged for the shoplifting. Do I stand a good chance of being rejected because of my young stupid self?

    No. It won't effect your issuance of a CWP

      How old are you now, and what county are you applying in?

      Regardless, make sure you disclose these things, or they can DQ you for not disclosing this information.

          Highly doubt that it will affect you and being honest and disclosing it will more than likely show them that you have nothing to hide.

            I can't help with specifics as im in Sac county, and really only familiar with their issuance, but I'd still disclose it. It's been 10 years, and you were a kid.

            I have a buddy who got his CCW here in Sac, and he had actual jail time on his record, and multiple drug violations, but that was a long time ago, and he's is a completely different person now. He was upfront about everything, disclosed everything in detail, and during his interview told the investigator "I'm not that guy anymore". He went into it fully expecting to be denied, but got it.

            The fact that you had it expunged and sealed will really help your case, but again disclose it, don't try to hide it. During the interview I'd tell them "I was a stupid kid, that did a stupid thing, and it made me realize I never wanted to be on the wrong side of the law again" or something like that. I really don't think you'll have a problem though.

              It's really going to depend on your issuing agency. That going to fall under the "Good Moral Character" provision. The issuing agency is allowed a lot of discretion to determine what is, and is not, GMC. Now that Peruta looks like it will (we're not there yet, still waiting for the trial court order) severely limit discretion on the "Good Cause" requirement, I suspect that GMC will be the next recourse for agencies that wish to be restrictive in the issuance of permits. There may a "Peruta - Part Duex" before this is all over.

              Your investigator will still be able to view records of the shoplifting offense, even it was: 1) Juvenile, 2) Sealed, and 3) Expunged. Please do not assume that your juvenile record was sealed just by virtue of turning 18. That's a common "urban legend", but quite untrue.

              I'm not familiar with San Joaquin County. Most agencies would not attach any significance to the traffic violation. The shoplift is significant, but the ten year period and juvenile status really mitigate it. I don't see that being a major issue in most counties, but it will cause your investigator to look more closely at your conduct during the past ten years.

                Disclose it. It's the honest thing to do. Plus, you can bet they'll know about it.

                    In Sac county I had what I thought was sealed, I put every time I talked to a cop. They had more of the facts than I could remember. So what I'm saying is if you think you did it, write it down.

                      If I were you, I would go down to your local court or wherever you need to get a copy of your criminal record. I was involved in shoplifting at 18 but the felony charge was reduced to a misdemeanor. I'm not sure if that'll affect anything but I plan on getting a copy of my criminal background.

                        The criminal justice system is a screwy circus. I tried this in the past and because it happened while I was a minor they could not release it to me without going before a judge and paying a revenue generating fee of $165.
