They make that statement like there is nothing they can do about the situation. Logic is dead in libland.

The important take away here is once the case is remanded, they will comply--as they should!!! The remand should come very soon based on all accounts I've seen.

Don't forget Scocca v. Smith looming over SCCSO's head.

The way I read it, they will not issue until Richards and Baker (or really any other ccw case that is brought up) are also settled because in effect they could overturn Peruta.

I think the only way Santa Clara county will issue is when they lose their very own lawsuit.

You expect smith to comply in a same manner? I think not. She's an expletive deleted.

Sonoma County's view is the same as Santa Clara I would bet.

Using their logic, no ruling, short of a Supreme Court decision, is ever enforceable because it MIGHT be appealed some day.

The Second Amendment is the one right that is so fundamental that the inability to exercise it, should the need arise, would render all other rights null and void. Dead people have no rights.

Not even then, because SCOTUS could grant cert to a similar case later on, and overturn their earlier opinion

Then argue both are correct and legal. She has to issue and she can still stop if the ruling changes again.

Worry about it when we have leverage. Right now they're going to say everything they can to convince people it's not worth applying. They will comply or be sued once Peruta is out of the woods.

Once the mandate is issued the suit against Smith should start moving again. There aren't going to be many options open for her once the Judge rules that Peruta applies to her as well. I do expect her to come up with some requirement that doesn't make sense but makes it a LOT harder to get a permit. Something like you have to walk backwards on a one inch wide board over a tank of sharks as part of the training requirement.
Limit politicians to two terms. One in office and one in jail.

Beware of people who are certain they are right. That certainty allows them to justify almost any act in pursuit of their goals. ( Jack campbell , Guardian)

I presume she will exploit the hell out of "good moral character" and take a page out of what Alameda County is doing currently.
