    CCW permit question

    Hi, I have a quick question for the crowd.

    I know that a standard California CCW specifies which gun (down to the serial number) that you're allowed to carry. Are any of the other permits more general?

    Specifically, can you get a non-standard CCW in California that allows you to carry a firearm even if you do not currently own one?

    Soooo......... you want to get a CCW and you don't own a gun?

    How are you going to pass the 16 hour class?

    I'd suggest you go to your county's website and read up on their requirements.

    Not trying to be rude - but a little more self education seems to be in order.

      No (Please refer to Penal Code section 26175(i) for the required content of the CCW license)

        You can only legally carry concealed firearm listed on your permit. If you don't have it, how can it be listed on permit

          Some issuing agencies in CA will allow you to carry a pistol that you do not own. So no, you do not necessarily have to own a gun to get a CCW, if you are being issued by such an agency. However it still must be specifically listed on your permit, down to the serial number. Only LEOs can CCW whatever they want. So you have to have a specific pistol that you will qualify with and list on your permit, down to the serial number. Check with your IA to see what their rules are, each agency is different about whose gun they will let you carry. But I don't know of any who let you carry a pistol not listed on the permit.

          Kern, Sacramento, San Bernadino, Riverside, San Diego, El Dorado, Tehama, Fresno - these are just a few agencies who do not strictly require the pistol be registered in the permit holder's name. There are others. In Placer, the pistol must be registered to the permit holder, same for OC.

            Per CA laws [PC 26175(i)]; all CA LTC permits must list the make, model, caliber, and serial number of the handgun(s) that the permit holder is approved to carry.

            Since you are only authorized to carry what is listed, carrying a handgun that is not exactly listed on your carry permit is a violation of CA laws [PC 25400].
            This includes a handgun being in a different caliber than what is listed. (caliber conversions)


            Penal Code 26175
            (i) Any license issued upon the application shall set forth the licensee's name, occupation, residence and business address, the licensee's age, height, weight, color of eyes and hair, and the reason for desiring a license to carry the weapon, and shall, in addition, contain a description of the weapon or weapons authorized to be carried, giving the name of the manufacturer, the serial number, and the caliber. The license issued to the licensee may be
            laminated.

                He could have sold or lost them? Unlikely, but possible. If he's claiming to have one tell him to present it.

                  If his CCW permit is current but denying owning a gun, he's most likely lying. All of California CCW permit holders owns guns

                    Or, at least they did when the license was issued.

                    But if they no longer own guns, they may not conceal-carry 'just any gun' to which they might happen to have access. As already noted, CA requires any handgun carried by a CA LTC holder to be listed on that license.

                      I suppose in some counties the spouse may technically "own" the guns, but that would be a rare occurrence where a CCW holder didn't own ANY guns.

                        I'll agree that nearly all CCW holders are also firearm owners, but it is legally possible for a person to hold a CC license, and not own (or never have owned) a firearm.

                        Penal Code section 26175(i) only requires that specific firearm information be placed onto the CCW permit. There is no requirement for the CCW holder to actually own the firearm(s) listed on the permit.

                          The Issuing Authority will run a check to verify the handgun(s) make model and serial number is registered to you (or spouse, if they allow it).
                          So, I don't know how you could obtain and renew a permit without "owning" a handgun.

                            Well, some IAs will do that; not all. There's no PC support for requiring that a handgun be registered to anyone, CCW or not, and once the gun is listed its identifying data is reported to CA-DOJ anyway.

                            One must, however, have legal access to some gun(s) such that it/they might be listed on the license. Personal ownership is the common 'legal access', but as noted, some IAs allow cross-listing weapons owned by a spouse, so in theory Mr X might actually own no guns of his own, and his IA might allow him to list guns owned by Mrs X.

                            I would think that unusual.

                              I would totally put all my guns under my wife's name.... on paper I think she looks like less of a threat.
