    References question?

    Okay, so I'm filling out the paperwork for a CCW, and I've come to the references page. According to it, I can't use family as references which of course makes sense.

    Would I instead be able to use my boyfriend and his family as references? They've known me now for several years and are CCW friendly, whereas most of my acquaintances and friends are...well, I don't know how they'd react to my having a handgun. Some I know are adamantly anti-gun, though most I think are neutral on the subject. But I know these folks would be all for it, I'm just not sure if they'd fall under the classification of "family" or not.

    Any advice?

    What county are you in? Every county is supposed to use the standard state DOJ application form which does NOT contain an area for references.

      I would think you'd be fine.

      My GF wrote a letter for Riverside.

      It's simply that other people know you and trust your judgement is a 'feel good' component of whether or not someone can be responsible as an indication to the issuing agency regarding your character.

      My letters were very short. Something like- I've known postal for x number of years. I understand he is interested in obtaining a ccw permit.
      I trust him to be a responsible and law abiding person, and recommend he be approved.... or some such. Really short and to the point- but clearly states they know it's for a ccw.

      And Jonw.... clearly you havent heard of riverside counties current requirements. Some northern counties require them as well.

      No it's not allowed according to law... but if you want the permit, you do as they say.

        I'm in Tulare county. Yesterday I took in my app and car registration and the clerk lady told me I needed to include the three references page as well before they'd start doing my paperwork. According to the page it had to be three non-family members, which prompted the question.

        I wasn't sure what constituted "family" - I intend to marry into this family (known them for years now) but they're not related to me legally or through blood so...?

        Anyway, thanks so much for the answers!

          Feel like rocking the boat? There's a risk involved.

          Penal Code says
          26175. (a) (1) Applications for licenses, applications for amendments to licenses, amendments to licenses, and licenses under this article shall be uniform throughout the state, upon forms to be prescribed by the Attorney General.

          (2) The Attorney General shall convene a committee composed of one representative of the California State Sheriffs’ Association, one representative of the California Police Chiefs Association, and one representative of the Department of Justice to review, and as deemed appropriate, revise the standard application form for licenses. The committee shall meet for this purpose if two of the committee’s members deem that necessary.

          (b) The application shall include a section summarizing the statutory provisions of state law that result in the automatic denial of a license.

          (c) The standard application form for licenses described in subdivision (a) shall require information from the applicant, including, but not limited to, the name, occupation, residence, and business address of the applicant, the applicant’s age, height, weight, color of eyes and hair, and reason for desiring a license to carry the weapon.

          (d) Applications for licenses shall be filed in writing and signed by the applicant.

          (e) Applications for amendments to licenses shall be filed in writing and signed by the applicant, and shall state what type of amendment is sought pursuant to Section 26215 and the reason for desiring the amendment.

          (f) The forms shall contain a provision whereby the applicant attests to the truth of statements contained in the application.

          (g) An applicant shall not be required to complete any additional application or form for a license, or to provide any information other than that necessary to complete the standard application form described in subdivision (a), except to clarify or interpret information provided by the applicant on the standard application form.

          (h) The standard application form described in subdivision (a) is deemed to be a local form expressly exempt from the requirements of the Administrative Procedure Act (Chapter 3.5 (commencing with Section 11340) of Part 1 of Division 3 of Title 2 of the Government Code).

          (i) Any license issued upon the application shall set forth the licensee’s name, occupation, residence and business address, the licensee’s age, height, weight, color of eyes and hair, and the reason for desiring a license to carry the weapon, and shall, in addition, contain a description of the weapon or weapons authorized to be carried, giving the name of the manufacturer, the serial number, and the caliber. The license issued to the licensee may be laminated

            Feel like getting denied?

            (thats the risk involved!)

            OP- Not married or otherwise legally family (yet) should be fine.

            However just my opinion, getting 3 letters from that family might not be best. I'd personally try to get at least 1 letter from someone else outside that group.

              If you're not married into the family yet and aren't sharing the same last name, you should be good to go.

                Forgive me for starting yet another post with the phrase "I fail to see the logic" but I fail to see the logic in refusing to consider the opinion of family making a positive reference when it comes to exercising your Constitutional rights, and then only considering the negative opinion of family when depriving you of both your Constitutional rights and your property (AB 1014).

                      No, postal has it right; the risk is to be denied for 'not following our (illegal) procedure'.

                          It would be a generic excuse that your good cause wasnt sufficient. Or perhaps moral character.... but I'd bet they hang their hat on good cause. They dont have to justify that. Where you could prove moral character with the POST moral character which *THEY* have to pass to be LEO......

                          Simply stated- you want a permit? play their games. If you DONT play their games, you wont get your permit.

                          Yes there are legal challenges to FORCE them into compliance. Did you want your permit? or did you want to wait and wait and wait and force the challenge?

                          I applaud the people who are challenging. They have my full support. I personally dont want to play games with my permit. I want it NOW! But I appreciate all the efforts going into forcing Rivco into compliance.
