CCW Permit Process

Forgive my inadequate knowledge of the law, but is the CCW permit process through the sherriff dept & DOJ an actual law? If so, doesn't the 9th district ruling trumpt the entire process?

Now for example, do I need a speech therapist's blessing to excercise my freedom of speech? Do I need a pastors blessing to carry my bible and exercise my freedom of religion? (you get my drift)

We all have training centers we need to go through and pass. Why can't we utilize these training centers like DMV offices?; you take a written & driving test, you pass, you get your permit/license.

CA9 ruling 'trumps' the SDSO application of the 'law' by saying that lawful self-defense is a good enough good cause for a license.

The majority opinion also has the potential to establish carry in some form outside the home as protected. If accepted, then barring a SCOTUS ruling overturning Peruta, we will have the means to overturn any law in the U.S. that prohibits carry for lawful self defense.

Yes I liken it to teen drivers ed. The state didn't want to pay for that so they eliminated it in high schools, wrote the laws to force everyone to comply with a training mandate and sprouted a completely new industry. That's how the Liberals build the economy - forced mandates which creates jobs and taxes.

Actually, not "any law in the U.S." The decision is only binding on the area covered by the 9th circuit. CA, OR, ID, MT, NV, AZ, HI, AK, Guam, and the Mariana Islands. Circuits outside the 9th (and some have opposite holdings on good cause) are not bound by Peruta. You can bring it in to a case from an "advisory" standpoint, but if you do that in a circuit that has an opposite holding it does you no good because that circuit's decision's are controlling on it's jurisdiction.

I get your drift however, starting a new licensing authority, training official, or DMV type of office that grants you permission to exercise your right is the wrong answer.

If you relinquish part your right in any way you begin the process of deconstructing the 2A. Its a slippery slope the anti-gun types have surely already considered.

This was how I got my Florida CCW permit way back in '96. The gun range I go to invited me and my sister, if we wanted to take a weapons training class at their range, and apply for concealed carry permit. It took 3 or 4 nights (2 hours/day), if I remember correctly. A week or so later, we received our gun training certificate and CCW permit in the mail.

Hey guys, I went to the link provided above and read through it a couple of times... the following section leaves me a little confused still:

To begin the process, applicants must complete a state-standard application form and submit it to the licensing authority. The licensing authority has a duty to collect the applicants’ fingerprints (if required; see, section 26185) and the CA DOJ background check fee ($95), and, if there is a local application fee, not more than 20% of the local fee, plus any local fee for fingerprint rolling. The balance of the local application fee can only be required if the license is issued.

I completed the ccw application and can't figure out if I am supposed to just send it in via snail mail, or if I am supposed to include a check, or if I am supposed to call for an appointment...

For some reason I just can't wrap my head around the next step after completing the application...

You could look at the instructions on the San Diego Sheriff's website: (pay attention to the Yellow background stuff).

If Peruta is overturned, but another case prevails, hinging your application on Peruta seems foolish.

In some parts of the state, this area is adequately filled with words to the effect of "for self-defense and defense of my family."

But I would never deign to presume to know why you would want to carry a concealed weapon.
