Live Scan Fee

These are exciting times!

I have a question regarding the Livescan fee.

I was previously denied a LTC by my County's Sheriff. I am going to apply again and I have an appointment in April. When I asked the gal that I set the appointment up with about the Livescan fee, she told me I needed to pay it again since it has been over a year since my denial(March 2011).

PC 26185 states:
(a) (1) The fingerprints of each applicant shall be taken
and two copies on forms prescribed by the Department of Justice shall
be forwarded to the department.
(2) Upon receipt of the fingerprints and the fee as prescribed in
Section 26190, the department shall promptly furnish the forwarding
licensing authority a report of all data and information pertaining
to any applicant of which there is a record in its office, including
information as to whether the person is prohibited by state or
federal law from possessing, receiving, owning, or purchasing a
firearm.
(3) No license shall be issued by any licensing authority until
after receipt of the report from the department.

would provide positive identification in the files of the Department
of Justice on the copy of any subsequent license submitted to the
department in conformance with Section 26225 and no additional
application form or fingerprints shall be required.
(c) If the license applicant has a license issued pursuant to this
article and the applicant's fingerprints have been previously
forwarded to the Department of Justice, as provided in this section,
the licensing authority shall note the previous identification
numbers and other data that would provide positive identification in
the files of the Department of Justice on the copy of any subsequent
license submitted to the department in conformance with Section 26225
and no additional fingerprints shall be required.

Nowhere do I see anything about a one year period limitation on the Livescan fee.

What would you do? Press the issue and risk ruffling feathers or just pay the fee again?

Seems to me that its one of those times when you have to ask yourself, do you want to be right? Or do you want to be happy?
Really doesnt seem right, but it just depends on who you are dealing with. Without knowing who or their attitude, I think I would ask a simple question.

Along the lines of DOJ aready has all my info and a quick computer check will show the last year, is this expense really needed? Then go from their.

Gotta leave her a way out. And the sad part is that DOJ history has not changed, she could pull your file zand see that, it would only be the last year they need to check on. But they hold the cards

^That's kind of what I'm thinking.^

It just irks me because of the history with this Sheriff. Even though he has relented on the good cause issue, he is still pushing the envelope of his authority over State law.
