    Pulled over CHP for cell phone

    So, to get things out the way, I'm fully aware of the cell phone law in California and know that I shouldn't have been doing what I was doing. However, I was unable to use my hands-free device because it was not working properly. Bonhead move on my part When the conversation wasn't really that important and could have waited.

    Got pulled over in Tracy because I had my cell phone pressed up to the side of my face. Upon being pulled over and gave my license, CCW, vehicle insurance, & registration. Immediately informed I was carrying and where it was. Was told to keep my hands on the wheel, while looking in my rear view mirror, it was definite that I was going to get a ticket as the first thing he picked up was the ticket book. So I know I have to inform my IA about the stop. However, do you think this is something that they would pull my permit for immediately, or deny renewal if this is the only thing?

    My IA is San Joaquin County Sheriff.

    Inform your IA with details of the stop. They should tell you how, or if, this will affect your permit.

        Better to post this on the San Joaquin CCW board as they're the only ones who might be familiar with how your IA handles things like this.

        That said, it would be patently unconstitutional for you to lose your ability to carry over something like this. That doesn't mean they won't pull your card, of course. It depends on how big of a "D" your sheriff is...or isn't. If you do get your permit pulled for this, I would reach out to CRPA and give them the details so that they are aware. It probably won't do much but it couldn't hurt.
