Merced CCW

Any input on Merced and how friendly this county is with CCW? Been thinking about applying for a long time now. Wished I was in Stanislaus county right about now...

As of about 3 weeks ago merced was not taking applications. I called the clerk and she didnt know when they would start taking apps. again? SHe said "maybe" next year. I guess we'll see.

Is that legal to not accept applications? If you went to register to vote, could they tell you they were not accepting applications?

Regarding Stanislaus county I believe they have softened up a bit.

For those interested in Merced County CCW:

I phoned Merced County SO today and was told that the Sheriff has placed a moratorium where no new CCW applications are being accepted. I asked when they would resume accepting apps and was told there is no set date but it looks like around January 2011. I asked if there was any way at all for someone to be processed regardless of the moratorium and was told "No."

I am ready to be processed for CCW in Merced Co. but it's pretty tough to play when the local Sheriff holds all the marbles and you have none...

It's called Salute v. Pitchess. That is the only marble you'll need for it that matters. Sheriff Pazin seems to think that processing CCW applications cost the department money even though the fees set by statute allow them to recover their costs as long as they aren't obsessively nitpicking an application to the point where the amount asked for won't cover the labor.

One of the things I've heard was that Pazin "set" a limit of 800 permits and intends to refuse applications as long as there are 800 active permits.

I am going to provide the Merced people with a simple solution and it will not cost you a dime.

First, keep in mind there may be fiscal and logistical reasons why the Sheriff has set 'Arbitrary' numbers. That does not make his decision any less illegal but something you want to keep in mind as you may need to present him with a solution for any problem he may perceive.

Contact the BOS member that represents you. Explain the problem and ask them to set a meeting between you and the Sheriff and County Counsel. Do your research and be prepared to make an intelligent presentation that the Sheriff may have his reasons for limiting the number, but he is apparently, always use that word when dealing with a CLEO, otherwise you are lecturing them and you will defeat your purpose. Anyway, tell him he is apparently violating Salute v Pitchess as well as 12050 PC. State law does not set any limits on CCW issuance other than Good Cause, Residence and Good Moral Character. Limiting the number is 'Arbitrary and Capricious' County Counsel will pick up on this even thought the Sheriff may not. CLEO'S are rarely attorneys. County Counsel, after hearing your presentation will realize the Sheriff is creating a legal problem for himself and will deal with the issue after you leave. Do not expect a resolution while you are sitting there.

Be ready with solutions, do not be confrontational as it sounds like he is pretty much Shall Issue.

This Brave had a similar situation with a brand new Chief years ago. Contacted my Council member who contacted City Attorney and set a meeting with Chief and Captain handling CCW Policy. Went over policy which Chief had inherited and he immediately conceded it was badly flawed. He directed Captain to redraft the policy and asked me for my input.

If this solution is beyond your residents skill set, you can hire this Brave and he will meet with concerned applicants and set up the Sheriff Meeting.

You all need to remember, issuing CCW's are a small part of your Sheriffs duties and he and Command Staff do not sit around pondering the matter. It is up to you, citizen, to bring issues to their attention.

Since he is "elected" (and I use that term VERY loosely as he runs unopposed), who would a citizen contact if there was a need to discuss or disclose something relative the sheriff/sheriff's department?
