What is considered a "clean" record? I have a DUI conviction approximately 5 years ago and a misd battery conviction approximately 17 years ago. Both have been expunged. No history of drug offenses, domestic abuse/stalking or mental health issues. Same employer for 22 years. I reside in Tulare Co. Is there a possibility of obtaining my CCW or will it be a waste of time & money? I am a registered gun owner for home protection.

Hi jcas74,
This may depend on the county you live in, so if you could share this it would help the community to help you. You will also need to have a decend good cause statement, again if you need help with this ask for it and someone will probably PM you and review your GC statement to give you a thumbs up or down. We are not allowed to discuss specifics to GC statements in the forum as far as I understand... well ... we couldn't say exactly what we used that was approved.
As for the DUI, in my county this did not prevent me from issue, however mine was over 10 years old, and I've had a clean record since then.
As for the misd battery, I suggest you provide the specific penal code that you were convicted with. While this was 17 years ago, and it was expunged, your age at the time of conviction might play a role. If you were a minor there is a greater chance this will not hurt you and a greater chance it is not on your record. The police have access to sealed/expunged records if records do exist, and there may simply be dispositions or other pieces of data out there that they will have access to. So, not that you would not be forthcoming about this as you seem to be willing to be honest, but if it was me I would hold off on applying until you have a better idea about this conviction.
Any kind of domestic violence, which could include battery I would imagine, can prevent someone not only from CCW but from owning firearms. Your expungement might be the only thing that has allowed you to own firearms, but then again maybe the type of battery does not count as DQ for firearms. So I suggest you find out, and share the specific penal code with the group. You should also anonymously contact the department of justice by phone, and ask if the specific battery conviction would DQ you from firearm ownership, and also ask about if CCW issuance would be possible and in compliance with the law.
If you are in a county that is shall issue or a likely to issue county, and this expunged battery conviction is not a big deal, I believe the fact a judge expunged it, that it was a long time ago, and that the DUI was 5 years ago will help you to establish that you have good moral character. I had an arrest and some convictions expunged from my juvenile record that were of a serious nature, for which I proved to the court I was not guilty. Being totally honest and upfront with the information surely helped my approval.
So, please share more details about your county of residence and the specific penal codes, and hopefully it will all work out in your favor.Last edited by GregsCCW; 11-09-2016, 12:50 PM.sigpic -
Orange County:
A tenant in my building applied for his CCW with the Orange County Sheriff Dept. He was denied a CCW without a reason but learned later he had a DUI within 5 years. Was informed to wait til 7th year to apply by an OCSD he knew when he called to inquire on his behalf!!
