    Denials based on PC section 26202

    Although I live in Idaho, I am a licensed attorney in CA. If you have been denied a CA CCW based on Penal Code section 26202, I offer one hour of free consultation about your denial. Please do not post your situation on this public forum. Instead, please PM me so our conversations will be protected by the attorney client privilege. In Idaho, all adults, who are not prohibited from owning firearms, can carry openly or concealed without the need to seek government permission. This is how it is in 29 states and how it should be in all states.

    Good luck! I think there is great potential in attacking PC §26202, either for damages or injunctive relief. Stupidly, they keep passing laws that violate Bruen, even after abandoning Bonta's quixotic moral crusade.

    My case arose prior to PC §26202 taking effect.

      I had no issues getting my initial or renewal here in CA. I am simply curious.

          Thanks for posting the statute. PC 26202 list the grounds or basis upon which a person is disqualified from obtaining a CA CCW. It is my opinion that, except for those provisions that parrot statutes precluding possession or ownership of firearms, these provisions are unconstitutional under Bruen and Rahimi and need to be attacked.
          Edit: I need to add unconstitutional under the Third Circuit's latest opinion in Range v. Attorney General
