    confused???

update sent in my "pfec" off to the doj on 1/2/13 lets see what happens came back feb/02 with great news yeah

I moved to CA about a year ago. I stopped in a shop and was asking questions.
well i was told that i need to buy the firearm first then do the paperwork and if i dont qualify i have to pay 20% restocking fee? is this right? I was told this is even on firearms that are on the shelf

back in colorado all you had to do was tell them you wanted to buy "this firearm" and they did the paper work.there was no restocking fees.

I was legal to buy in CO but i dont want to spend cash on a restocking fee because CA is over regulated or something.

    any help would be great

they probably have the restocking fee, since in california there is the 10 day waiting period, and while its on hold for you for 10 days, they can't sell it, so if you fail the check they want to recoup for the 10 days that the "gun could have sold" to another customer; that is why they they charge a restocking fee. its proably just that store's policy.

is there a waiting period in colorado or is it instant? if its instant, they dont really have much to lose from putting it on hold for you for 20 minutes.. but 10 days is a long time to not have a gun on the shelf available to be sold.

maybe someone else can chime in. in california do they make you pay for the gun first or do they just charge you for the background check fee?

here in nevada, i have had it work both ways. one place only made me pay the $25 nics fee up front, once i passed the background check (20 minutes later), they had me pay for the gun. another time here in nevada, the store made me pay for the background check AND the gun up front, before they even ran the background check.

you can always run a Personal Firearms Check on yourself with California DOJ, before you attempt to buy a gun in california. http://oag.ca.gov/firearms/pfecfaqs

in colorado it would take 1hr tops on a holiday weekend and you walk away with the firearm.it is also legal to do a face to face with out a ffl. I've been at a gun show talked to a guy and walked across the street to wendys and bought the firearm from him legally.

if you are concerned about your eligibility to purchase or posses a firearm in california, i recommend you do a PFEC, basically just take the form and go down to a notary (like the UPS Store), send it off to the doj.

the california department of justice will then run a check of california records and the nics database i think, then mail you a letter back in a few months which will tell you if you are legal to purchase and/or own a firearm or not.

check out this link for more information http://oag.ca.gov/firearms/pfecfaqs

by the way, what made you leave colorado for california? the gun laws are just one of the many restrictions and over regulations in that state. you know a lot of cities in california now are either banning plastic bags or making you pay 10 cents a bag.. not to mention that CRV tax of 5 cents you have to pay on most bottles and cans, that you never fully get back! LOL

so you moved with a job lined up, but it fell through? what part of california do you live in? if you are in I.T. software developer or systems administrator, the bay area is hiring like crazy right now for those type of jobs.

when i lived there, i was in the bay area.
