    Hi all,

    I am a grad student at UC Berkeley and live in Berkeley, CA. I used to go shooting a lot in high school and undergrad, but would always rent since I did not own. I have always wanted a few pistols and rifles, but never got around to it. I am thinking my first purchase will be a Ruger SR 22. since the ammo is cheap and I have heard nothing but rave reviews about it. I was also looking at a S&W M&P22, but they are not legal in CA (hopefully soon). After this, I am thinking a 9mm or 40S&W such as a SR9, P99, M&P9 or P229. Sigs were always my favorite pistols to rent.

    I have a few questions though I am hoping you guys can answer.

    1. CA laws states that you must either have a gun safe or purchase a locking device. I assume I will get a locking device with whatever gun I buy. I would probably also like to get a locking hard pistol case for storage and transport. I am unclear on how I am required to store. In case, In case with locking device, locking device only, ammo in completely separate container, etc?

    2. I live just over 1000 feet from the main UC campus, but within 1000 feet of UC owned buildings such as the health center and some grad dorms. I do not live within 1000 feet of any public K-12 school. There are one or two day care centers either ran by UC or part of them, and maybe a church affiliated school within 1000 feet of my house though. I live in the bottom floor apartment of a large subdivided house. Each apartment has a separate address, not an apartment number if that makes any difference.

    I know that the GFSZ law states I can have a gun in my residence and in my car for transport, but what happens when I take it to my car to go to a range? I park on the street, so to walk to my car I would have to leave my residence. I would be on the property that encompasses my residence (the lot), but I am not sure if this is still considered part of my residence (maybe the path from door to sidewalk is?). After than I would obviously have to step onto the sidewalk and possibly street to get to my car. I would plan on parking as close as possible obviously. I am curious as to the legality of this. I an unclear as to when "motor vehicle transportation to/from range" starts and begins.

    The lot has a driveway on one side which is rented by tenants of other apartments of the house. I can park the car there for a bit. Would it be best to do that, so I never have to leave the overall property between front door and car.

    3. When transporting, I would put on locking device, in hard case. Can I put the case into a backpack, that then is put into my car's trunk. I want to be as discreet as possible.

    I know its long, but thanks for reading and any advice. There was a student involved shooting a few months back, so I would not be surprised if UCPD/BPD have a list of students who have registered guns etc.

      Welcome Mike and congratulations on a great school. You ask a lot of questions that are good to know.

      Berkeley has some very interesting Laws covering a lot of things I am guessing weapons is also one of those exceptional rules. I would contact the local PD and ask these questions make sure you get the badge number or name of the officer you talk to when you base your decisions on what they say.

              I reread the Berkeley Municipal Code again, and there are no restrictions on firearms that the state does not already have. There is a tax on ammo sales and a repealed ban on semi automatic guns though.

              I had read the wiki, but missed this. Under the transport page, PC 26610 "(2) The firearm is carried by the person directly to or from any motor vehicle for any lawful purpose and, while carrying the firearm, the firearm is contained within a locked container." - I would be following that. The word private property is a little ambiguous to me though. Not sure how the property I am live in is defined compared to other apartments of the house, and if crossing said boundaries is ok, even in direct transit to my car.

              I should recheck my lease for any restrictions and see what the company who owns the place defines address boundaries. Since I would keep the case tucked away in my closet, I assume that if a landlord/inspector/worker "found" it, this would constitute a search of belongings without my permission.

              Thanks for your help - I'll talk to BPD when I get back. Hopefully I can find a SR 22 in stock.

                      Welcome. When you buy the gun you will not get a safe. I bought one of those small fire safe like from home depot to cover the safe law. Take it with you when you pick up your gun.
