    AB28 11% Ammo/Firearms/Parts Tax Effective 7-1-2024

    Are there plans to attack this erroneous tax? If so do we have to wait until July 1st when it takes effect?

    “Under Assembly Bill 28, which Governor Gavin Newsom signed into law on September 26, 2023, an 11% tax will apply to gross receipts from retail sales of ammunition, firearms, and firearm precursor parts starting July 1, 2024”.

    I just watched a short video at CRPA. It was mainly asking folks to have Newsom veto the bill, but there was a comment by one of the CRPA lawyers that if the bill was signed into law, CRPA would file suit.

    At this juncture, it's a wait and see. Keep an eye on the CRPA site as time goes on.

    This is another egregious law that harms law abiding gun owners, and no one else; a disproportionate tax on one group, only.

      This is discrimination of people who exercise their legal rights. Punitive taxation is illegal as I understand it. These folks in Sacramento are not very bright. They are pushing more and more people out of state.

        Everyone who flees California due to failed left-wing policies should be required to vote Republican at their destinations.

        The Second Amendment makes us citizens, not subjects. All other enumerated rights are meaningless without gun rights.

          Does this new 11% tax also apply to primers, powder and gun parts?

          If so I'll pick that stuff up out of state. Remember, ammo will be automatically 11% cheaper across the border.

            The excise tax does not cover ammunition components but does apply to firearm precursor parts.



            36011. Imposition and rate of tax. Commencing July 1, 2024, an excise tax is hereby imposed upon licensed firearms dealers, firearms manufacturers, and ammunition vendors, at the rate of 11 percent of the gross receipts from the retail sale in this state of any firearm, firearm precursor part, or ammunition.
            A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

            The Second Amendment makes us citizens, not subjects. All other enumerated rights are meaningless without gun rights.

              HOWEVER....
              You are exempt from the TAX if your gross quarterly receipts for guns, gun parts, or ammunition are less than $5000.

              So, now it is ironic that the State whittles away at the right of its citizens to defend themselves from the possible oppression of their State.

                  (a) There are exempted from the tax imposed by this part, the gross receipts from the retail sale of any firearm, firearm precursor part, or ammunition to any active or retired peace officer or any law enforcement agency employing that peace officer.

                    The Supreme Court really ought to strike law enforcement exemptions to gun control laws wholesale as unconstitutional.
                    A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

                      You are getting in backwards. Subjecting law enforcement to the same unconstitutional laws as non law enforcement will not benefit you. Instead, the unconstitutional laws need to go.

                        The core problem stems from how numerous police unions, including here in Virginia, have backed all manners of gun control laws, giving Democrats political cover and enabling campaign messaging that claims law enforcement supports their agenda. If the exemptions did not exist, perhaps the organizations might join Second Amendment advocates in unified opposition.
