    Selling registered AW to a person in a free state

    If any of of you legal savvy Calgunners have answer to this I would appreciate a little help.

    Is it legal to, and if so how would one legally sell a California registered assault weapon to an individual or ffl in a free state as a California resident?

    Would one need to notify California DOJ of sale?

    Legal.

    Take it out of state yourself; shipping requires using a CA FFL with the 'assault weapon' license.

    Interstate transfer requires using an FFL, so can't sell privately to an individual.

    There's apparently a way to un-register an AW, so you should do that.

    Don't expect a lot of money for a RAW - they're a big deal (at least administratively) here, but just everyday guns most other states.

        Or de-register and then ship disassembled directly to FFL out of state.
        De-register confirmation probably takes a while though...

          For the most part others have answered your questions. The important part to note is that because it would be an interstate transfer, it must go through an FFL in the buyer's state of residence. There is no need to notify CA DOJ. And, as Librarian stated, it might be best to transport the firearm out of state yourself, because otherwise the shipping CA FFL would need an assault weapons permit. However, it is unclear to me whether or not you could personally simply ship it to an out of state FFL, for delivery to your buyer, given that under Federal law it is merely a long gun.

            If you want to ship it yourself, it needs to be de-registered first.

              You can't "de-register" all CA assault weapons. Many are "named" in the law and can't be made into a form which allows them to be "de-registered".
