11Z50, thanks for the info on the situation. My personal thing about cops is that I have never trusted them and will never. I have met some cool cops in my life. But the majority of them are total tools that prey on the weak. Which real is most people. Not because they themselves are weak but because the laws are on the LEOs side. I've been attacked by cops a couple times for just skateboarding. Mind you I didn't try and run from them when this happened. The most recent one was two cops that attacked me while I was by myself skating. I've also had to defend myself from two attackers(not cops) with my knife. That landed me three hours in a holding cell and my knife and board put into evidence. That happened at a skate park in Huntington Beach.

      Penal Code:
12031. (a)(1) A person is guilty of carrying a loaded firearm when he or she carries a loaded firearm on his or her person or in a vehicle while in any public place or on any public street in an incorporated city or in any public place or on any public street in a prohibited area of unincorporated territory.

      (e) In order to determine whether or not a firearm is loaded for the purpose of enforcing this section, peace officers are authorized to examine any firearm carried by anyone on his or her person or in a vehicle while in any public place or on any public street in an incorporated city or prohibited area of an unincorporated territory. Refusal to allow a peace officer to inspect a firearm pursuant to this section constitutes probable cause for arrest for violation of this section.

        I will clarify not recant.

An officer needs probable cause (or some other exception such as emergency, or search incident to arrest, etc) to gain access and search your vehicle. If you are pulled over for speeding, you simply do not need to answer questions about "what is in your trunk". If they have pulled you over b/c they have a suspicion you were in involved in a shooting or were shooting in an area that is prohibited, they might already have their PC (combined with the vehicle exception) to search your vehicle for guns even if you withhold consent.

But YES, you are correct, this probable cause requirement is eliminated if you disclose to an officer that you have guns in your vehicle. Then, under the PC section you listed above, they can demand to insure they are unloaded and that you aren't in violation of concealed carry laws.

BUT AGAIN, an officer can't just go diving in your trunk or passenger compartment to see if you have guns there anytime you are pulled over or contacted by an officer. They must either be TOLD there are guns in there OR have probable cause that you have illegally stored guns in your passenger compartment or trunk.

NOTE: they are conducting this search to insure that the guns are unloaded and stored safely.

So basically if you're minding your own business out on BLM/Public land (unicorporated county areas) you can tell them to piss off? LOL...

I'm not giving up any of my hicaps... sometimes Ill take my rifles to Nevada (10mins inside stateline) just to shoot them like they are supposed to be.

I often worry that a cop will try to take my hicaps so I just bring 1 or 2...

You've been "ATTACKED" by police officers? Do you have photos of the black eyes, bruises, broken bones, etc? I don't believe you were attacked by any LEO's, I do believe you've been questioned by them, even that you've been taken into custody, but not "ATTACKED" by them.
You really need to ask yourself why you're attracting so much attention from LEO's? Is it your appearance, 'tude, etc? Do you dress the OG part? If you dress and act like a 'banger or a punk they will treat you like one.

I dress like a young professional, drive a clean looking car and I'm respectful...

And I've been thrown on the ground 2x in my life so far by San Berdoo County cops... I believe a lot of the "abuse" allegations now because corruption runs rampant out here in the desert...

I agree tho, if you look like a scumbag you're more likely to get profiled...

Sgt Raven, my definition of being attacked in this case was when I was just standing there after the cops told me to get off my board and they both rushed me. Both of them took my hands and put them behind my back in the most uncomfortable position. Then as the one held me there almost taking me off my feet the other one searched me. The other time a cop threw me against a car. Meaning he took me by the arm on one side of the car and did a 180 so I ended up on the other side of the car. So I believe I was attacked in both cases.

Probably just cuz he was skating around....

And that my friends is profiling...

I hope you don't do this based on race as well!?

As far as I know dressing like a "banger" is legal, so is having a bad attitude.
I however believe most of the time, people will treat you as you treat them.

Skate boarding can be done illegally, which may be the case here. He may have been detained based on this. I however hope it was never because he looked the part.

I happen to be white, dressed in slacks and a work/semi-formal shirt and I don't believe I have ever been "hastled" because of it. I have however been a passenger in a car with a driver who was pulled over for "driving while black".
I've also been the subject of unwanted LEO attension based on my friends' horrible taste in dress.

I'll save the story for another time, but damn I'm glad im not black and drive a jaguar. Needless to say I felt horrible for him.

I'm not a LEO. But if you come around me acting like a *** you'll definitely be on my radar. I spend every waking hour in "yellow" and lots of things get on my radar. Its to bad that CCW's are so hard to get because the axiom " An armed society Is a polite society" is true.

                        Funny story:

An old highschool buddy of mine was pulled over for driving with a dirty license plate. He spent an hour sitting on the sidewalk while they searched his car and then released with a ticket for the plate.

He wasn't even speeding or drunk or anything like that. Think driving "brown" in a white neighborhood has anything to do with it?

He's been a Orange Co. deputy for over 10 years now. He's always wanted to be a LE, but that little incident was the one time he almost changed his ambition.

                          ...well, you get the idea.

Well, Im with you since you included "quacks like a duck", which would mean "one" acted illegally. (The action part of the cliche)

However, the discusion here seems to be more related to the first two parts-- If it walks like a duck, looks like a duck, it may or may not be a duck.

I think that would be more fitting for this debate.
