    Right to Open Carry

Question about the open carry law and the legalities of it in California. If I was to go walking down the street with a gun on my waste or even went into a store. Where do I keep my mag? In my pocket? Are their different laws or when I am driving a car?

I guess I could have googled this but since I was in the Forum I was just kinda curious... plus I didnt wanna stumble upon some internet junk laws!

    Thanks All!

Frozen in 2015, it is falling out of date and I can no longer edit the content. But much of it is still good!

That open carry website is an awesome source of information, but there's a lot of information to wade through!

To answer some of your questions and save you some time:

DO NOT place mags in your pocket. It can be considered a "concealed weapon" because it is an "integral part of the firearm" (stupid, I know). Most people have a mag holster on the opposite side of their firearm. I keep one loaded mag in a mag pouch on my holster.

Same exact laws while driving and walking.

Please take the time and do research before you venture out though. There's much more to it than just the questions you asked. It'd be a bummer to not educate yourself properly and end up losing your rights...

I don't have any firearms which I dislike enough to place on my waste. Theirin lies the rub. YMMV.

californiaopencarry.org is an information clearinghouse site with lots of info for the beginner. Use OCDO to ask questions. Don't even attempt this without a lot of research and a TOTAL understanding of the issues and risks.
False is the idea of utility that sacrifices a thousand real advantages for one imaginary or trifling inconvenience; that would take fire from men because it burns, and water because one may drown in it; that has no remedy for evils except destruction. The laws that forbid the carrying of arms are laws of such a nature. They disarm only those who are neither inclined nor determined to commit crimes.

I laughed when I read waste too. haha.
I don't think there's a law against carrying concealed in your own excrement. (Kind of like L.U.C.C.)
I would classify that weapon as "not readily accessible".

Does a porta-potty qualify as a locked container?

Mags must be visable in a holder, The firearm must be unloaded unless in an incorporated area where discharge of a firearm is allowed and you cannot OC if knowingly within 1000 Ft of a K-12 school. And putting a firearm on your waste will make it very difficult to clean...
Sorry, Couldn't resist. That thing you put your belt around is a waist. That thing you do every morning and evening is waste. I know it was just a spelling error. Butt it is funny!

No, the law says nothing about magazines. Only the firearm.

                              Right and wrong.

Nothing in the penal code about it, but case law People v. Hale states that a magazine is an essential component of the firearm and concealment of such is considered a sufficiently concealed weapon.
