I have doctor's orders to avoid alohol, that I finally got hime to amend in a writing in order to please my family, to one ounce of wine. If the news from court is good, I am having at least one Cadillac Margurita.

Of course it will be appealed in a flash, but I expect that Judge Benitez's Order/Judgment will be well crafted and may even possible convince he 9th CA to let it stand. Nah, not our 9th.

We expect a written ruling will issue, as this is the normal procedure for the federal courts even if an oral order is issued from the bench. Then again, I have had a judge read a lengthy decision from the bench that was never reduced to a writing except "Motion to strike sustained without leave to amend." One would have had to order the transcript to get the oral ruling. That is unlikely in this case where an appeal is a virtual certainty.
