    Bushy XM15 --> CA Legal

    Hello CG!

    I have a good friend and fellow range buddy who recently moved to Southern California from Texas. He bought a Bushmaster XM15 at Cabelas in Texas however now that he moved to CA he realized that the XM15 is on the banned guns list.

    He doesnt have very mich money and is trying to figure out the best way to make the rifle CA legal. He bought a pinned mag and installed a bullet button but it seems the actual weapon is banned.

    Any and all options would be greatly appreciated!

      I could be wrong, but I believe it was a "named gun" on the original ban of something like 19 particular guns.

      If that is so, best advice would be to keep the receiver out of the state and just buy an unnamed BM lower or another lower and switch the upper. Sell the XM15 one to recoup losses.

      I'm sure someone more knowledgeable than me will chime in.

        Get a new lower and dispose of the old one. Problem solved, probably for less than $150.

          Got it....I am assuming he could use the upper and just purchase and Register a new lower. All set....as you said sell the XM lower to recoup monies spent.

            Each of these are a separate offense...
            Bringing it to CA = felony
            Possessing it in CA = felony
            Advertising it for sale, while physically in CA = felony
            Transporting it in CA = felony

            The felonies start adding up.

            If it's already in CA...
            Legally, he should acquire a lawyer and arrange to have it surrendered to LE for destruction in lieu of criminal charges.

              He needs to contact a lawyer to arrange it to be surrendered to law enforcement. That is his ONLY legal option in CA. Of course, that only means the receiver needs to be turned in. Also, once the receiver is stripped, it is no longer a "rifle" under CA's legal definition of "rifle". So, it is no longer an AW under CA law. But, that is still very risky and could cost six figured to stay out of jail. So, just advice him surrender it to LE.

                Getting a lawyer to arrange surrender to LE is good advice. Do NOT just walk in on your own and turn it in though.

                Alternatively, a blow torch to completely destroy it is another option. (Not that it fixes anything legally, since if it is already in the state then the felony has already been done, and not even destroying it will undo a felony, but it keeps from continued commission of felonies)

                Transfer all the guts from the lower to a new lower, and you're good to go.
