HELP!!! Deciphering Section12025

I would like to know about this section's exemption,

Section 4. POSSESSION AND TRANSPORTATION OF CONCEALED WEAPONS

(Page 33)


"Penal Code 12025 does not apply to or affect the lawful transportation or possession of a firearm under specific circumstances, including, but not limited to, the following;" "Licensed hunters or fishermen while engaged in hunting or fishing, or while going to or returning from such hunting or fishing expeditions."

I read english and what this means to me doesn't necessarily mean what the Law states.

So, If I am going fishing or coming from fishing and have on my person a valid fishing license then I can carry a concealed firearm without a CCW issued by any county. That is what I get out of this statement, AM I RIGHT?

If I am right, what would be any repercussions if I was to get stopped by law enforcement on the way to or coming home from a fishing expedition? Do you think that all Law Enforcement officials know about this exemption in the Law?

I appreciate any and all answers and thank everyone for taking to time to answer this Question. If I have entered this inquiry in the wrong section of this forum please advise me as to wheather this question can be moved and to what forum.

If you have a valid fishing license and do not have a valid CCW permit, you can legally conceal carry an unloaded handgun while traveling to and from your fishing spot. When you are at your fishing spot and fishing, you can legally conceal carry a loaded handgun.


Penal Code 12027
Section 12025 does not apply to, or affect, any of the following:
(g) Licensed hunters or fishermen carrying pistols, revolvers, or other firearms capable of being concealed upon the person while engaged in hunting or fishing, or transporting those firearms unloaded when going to or returning from the hunting or fishing expedition.

If I am right, what would be any repercussions if I was to get stopped by law enforcement on the way to or coming home from a fishing expedition? Do you think that all Law Enforcement officials know about this exemption in the Law?

Not all LEOs know about this exemption.
So, you can be detained and/or arrested for conceal carry of a handgun without a permit [PC 12025(a)]. Your lawyer will have to bring up the exemption in court to get you off.

If they do know about this exemption and you are traveling to and from your fishing expedition, they can still check your handgun to see if it is loaded [PC 12031(e)]. If it is, you can be arrested for having a loaded firearm in public [PC 12031(a)(1)]. Because the exemption only allows for the conceal carry of an unloaded handgun while traveling to and from your expedition [PC 12027(g)].
