Default I'm 16, and I want to build an 80%

I posted this in Junior Shooters, and reposted it here for a wider audience.

Hi, I'm on my fathers account currently.

I'm 16, and want to build an 80% AR. With these new laws coming up in 2018 regarding 80%, I'll be 17 then close to 18. I want to avoid all of them mainly the part regarding acquiring a serial number from the DOJ, and proving that I engraved it on the AR. I'd much rather engrave my own stuff/ info.

My main question is: Can I build an 80% AR-15 as a minor in California? I've read some other threads here, and they've mainly said yes because a minor can own a firearm transferred via parent, and because they can... I can make a firearm. Is this true? I've looked pretty thoroughly through the states special laws and what not, and have not seen anything regarding age, except for pistols. I've seen in the AB 857, it says under Section 4 "An application made pursuant to subdivision (a) shall only8 be granted by the department if the applicant does all of the following: ..... (2) Presents proof of age and identity as specified in Section 16400. The applicant shall be 18 years of age or older to obtain a unique serial number or mark of identification for a firearm that is not a handgun, and shall be 121 years of age or older to obtain a unique serial number or mark of identification for a hand gun." From my knowledge, this doesn't come into effect until mid 2018, so if I finish my firearm prior, this doesn't/ shouldn't apply to me? I know I'm asking a loaded question, but I really want to build a m16a1/603 build.

Under current Federal and CA laws...

A minor that is a non-prohibited person can legally make a rifle or shotgun for personal use.
It's illegal for a minor to make a handgun.

The "80%" AR15 style semi-auto centerfire rifle needs to be made as a "featureless" semi-auto centerfire rifle or as a semi-auto centerfire rifle with a fixed magazine.

The "80%" firearm will need to be engraved with your info prior to 07-01-2018.


Also...
Starting 01-01-2015, the minimum age for a parent/grandparent to transfer (gift) a firearm to a child is 18. [PC 27875(b)(4)]

There's always the option of ordering a 603 lower from Nodak spud and having it sent to an engraver with your engraving once the receiver is ready. That said you'll probably be waiting half a year before you get your turn.

^The process for obtaining the CA DOJ identifying markings will register the firearm.

Starting 01-01-2019, importing/making/possessing "home built" firearms without any identifying markings will not be legal. [PC 29180(f)]

Yea, I contacted them... they told me that they don't have a re-stock date, but expect to make more by the fourth quarter of 2017. Than being said, I was going to send an a2 to a retro engraver that can make the a1 cuts to the buffer tube area, and the pivot pin area. With the Colt engraving marks, and the a1 cuts, It'll be cheaper than buying a Nodak, and having the Colt engravings on it.

So that means I can't own a firearm? .... Meaning I can't make my own firearm?

Since an AR 15 lower can be assembled as a legally configured handgun or rifle, must the person manufacturing one for their own use from an 80% lower be 21 years or older; and based on this would prohibition to a minor apply?

Ok, so its been 33 years since I took the hunters safety course, but i remember the part where in California a minor, 14 years or older could possess a long gun that was legally purchased by an adult, but only in unincorporated areas. I lived in a B.F.E part of the Imperial Valley, and at 12 years old I had my own 12 gauge, a 10/22 and a Mini 14. I guess I was breaking the law even back then.

Of course that was 1984, and gun laws have changed some since.

No laws were broken back then... all that was legal under CA laws.

CA laws have changed since then.

Starting 01-01-2014, minimum age to be gifted a long gun by an immediate family member is 18.
