Cool 10 day wait exemptions for modern rifles with COE and FFL03?

I am sure this has been asked and answered ad infinitum. I can't seem to find the thread I've read on it before though.

Here is what I've heard over and over, quote from an FFL07 and store owner re: several questions about ppts and wait times etc as I had an FFL03 and COE:

"I am all over most of the laws and I use the actual penal codes, and gov publications, rather than opinions from other dealers or calguns (not that they are necessarily incorrect).

However, under any circumstances you will have no 10-day wait, and no 30-day restriction (for handguns), no matter if the firearm is 50 years old or not. That includes buying new firearms as well, at all dealers (if they know the law)." Owner of gun store in American Canyon.

But, always a but. My current FFL says he can't and cites this FAQ listing 10day wait exemptions which says I am NOT exempt:

"Persons who have a Curio & Relic Collector's license issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) and who have a valid Certificate of Eligibility (COE) only when purchasing curio and relic firearms. The dealer must retain a copy of the Federal Firearms License, Collector's license and the COE."

Can someone help clarify this for my current FFL? He is open to an exemption, so long as he's sure its legal. I'm also asking the store owner, I'll share when he gets back to me.

I understand that any advice isn't legal advice etc. Etc.

I'm okay with waiting 10 days this go round, but if next time I can avoid it? Heck why not.

Modern rifles have the 10 day wait. Even with COE/FFL03

FFL03+COE can be used to buy curio rifle or curio handgun without the 10 day wait.

Also , You can get shipped Curio rifle with FFL03+COE but not handgun, but you can buy curio handgun without the 1 in 30.

That was my understanding. But then my original FFL got my hopes up. Thanks for confirming.

No problem - It can be confusing. Once you go through all the scenarios once it becomes much clearer.

I should clarify on the Handgun portion - The reason why you can't get a handgun shipped on FFL03+COE is because of PEN 27585 and 27565 specifically requiring a handgun to go through an FFL for transfer regardless of it being a C&R or not.

But at least you won't have the 10-day wait and no 1-in-30 restriction on it. You just need an FFL to take the shipment and do the DROS over to you.

I believe that the rifle has to be in Ca, outside Ca it needs an FFL01.

That is also my understanding. The law changed a few years ago for C&R rifles. A few threads quote the PC regarding this. If the OP wants to verify, search the threads.

If the C&R eligible rifle is outside of CA, my understanding also is that it has to be shipped to a 01FFL, unless you acquire the rifle out of state in person, being a 03FFL holder
