I doubt Thomas will retire, as his ego needs exoneration. Since Day 1, he has been put under a cloud by progressives (remember Anita Hill?) He now feels the shift, and I believe it is his fervent hope to write for the Court, putting his name on landmark opinions which are concurred with by the majority. That will reinforce the conservative positions he has held on the Court for the last 28 years, and cement his judicial perspectives in time along with his predecessor, Thurgood Marshall.

Default SCOTUS this year - a good sign

Supreme Court Justice Ruth Bader Ginsburg, who faced two serious health scares in the past year at age 86, is looking ahead to a 26th year on the bench and hinting at "sharp divisions" ahead for the court.

Ginsburg previewed the court’s next term in a speech Friday at the Second Circuit Judicial Conference. She said two cases from the circuit – a gun rights case and an LGBT employment discrimination case, both out of New York – “will be front runners.”

The remarks signaled Ginsburg’s characteristic determination to stay on the bench, defying speculation that she may be nearing retirement by choice or infirmity.

Not surprisingly she predicts a split on the NY gun case. We can infer from this that she's already made up her mind on how she'll rule before even hearing the arguments.

We already knew this is how it works but they don't usually say it out loud like that, so that was interesting.

Four decisions. Three of them decided on a decidedly unusual division of the Justices. Conservatives and Liberals voting together.





Gorsuch, Thomas and Ginsburg voting on the same side?

The fourth case, decided on more traditional Conservative / Liberal lines.

None of them are gun cases.

After the bar admissions, all eyes turn to Marshal Pamela Talkin, who announces that court is in recess until Thursday. It will be the first extra opinion day of the term, and with 20 opinions remaining, we all may need a big gulp of something to be ready for it.

Read bits of Comrade Ginsburg dissent from the recent cross decision. “Conveys message of exclusion to nonchristians”? Damn, how much I hate this ideologue. I think it is perfectly ok to wish death upon tyrants.

It's the internet. Everyone's a crazy conspiracy theorist. Best I can tell, the video is recent.

Thanks for pointing that out. I had missed it. So the speculation over her condition is pretty much moot now... unless one wants to argue she has some inoperable tumor or some such. My new expectation is she will make it through Trump's first term. We need the 2020 win, gentlemen.

I suspect she's been in public life long enough (and had enough health scares) to know that she needs to be out there doing speaking and being seen.

I personally think she still has serious health problems, it's just hidden from the public. I suspect her cancer battle is still going on we just won't hear about it.

Yeah, she got up quickly with no shakes or need of support. I wasn't expecting that from someone with hunched body posture. She might simply look worse than she really is. Honestly, after seeing that, I really think she'll live past 2020.
