Default Last Buy on the Old FFL

Taking a break from setting up electronics in the OR (retirement) home and visited a LGS last weekend. FFL expired December 1st (renewed) and was hoping to get in a last buy.

A more than slightly used Colt DS, short framed post 1966 type -

I suspect a very old but generally well done rebluing was done on the gun, or some part(s) anyway. Sideplate and frame edges are nice and sharp, but either the screwholes are slightly dished or the screws were buffed.

Opened it up, the mainspring and cylinder bolt body are blued, which they shouldn't be, and that plastic white plug on the thumb latch has a blue hue to it.

No sales tax and no OR background check - just a sales slip.

I have a 1958 made DS ANIB, this one isn't and will get shot often.

Awww... No background check or waiting period or sales tax on used gun purchases... Brings back memories.

Great little revolver, and the patina just makes them more desirable to me.

Interesting, because Oregon’s state transfer laws do not exempt C&R FFLs or CHL holders.

Rather than do the "defensive crouch" I looked up OR law.

The only exemption I see is dealer to dealer.

Were this a one off transfer I'd say that ends it and a mistake was made by this dealer. That so many OR dealers are doing otherwise, I'd like to look further. I'd wonder if OR 166 applies to OR residents only? Or, if the background check is run in state only rather than nationwide (which I think is why the CHL holder exemption ended - the medical MJ case a few years back) and there's no record of me to check, so the check would show nothing, result is a next day release? Which doesn't alleviate from actually doing the check, but makes it redundant?

Maybe there's a reason, but I'm now going to pick up a 1961 made Smith Model 34 in Mountain View - which definitely does require a background check even with my FFL and COE.
