I don't know if anyone has mentioned this, but how many people in California are killed every year because of an 'unsafe' handgun/accidental discharge? This seems like a sound argument to me, like one of the judges in the case for background checks for ammo? How many people were charged for trying to buy ammo? Such an incredible waste of time/money/ resources when gangbangers are responsible for most of the violence.

I do not think the cases were consolidated as this is just the PI stage. The 9th held the stay motion hearings consecutively (Renna then Boland) for obvious reasons.

Facts do not matter. When they banned ccw in schools, there was no testimony that ANY accidental shooting by a licensed carrier had EVER occurred. It is all about "feelz." Do you think that the Legislature cares whether gangbangers shoot each other? If they did, there wouldn't be all this catch and release. Although the Roster was early on to require drop safe and reliable pistols, it has since become a political tool to limit the availability of handguns, specifically semiautomatic handguns, available for sale here, with the eventual goal of making it impossible for manufacturers to sell them here profitably. (or at all).

Couldn't place my finger on it yesterday. What really bugs me about Judge Berzon is she seems to be examining this case from the standpoint of "How can I uphold this excellent California gun law?" rather than "How can you (the State) prove to me your law is in full conformance with the Second Amendment?" I don't know how there is no internal mechanism for the judicial branch to reel in activists.

They held 2 separate hearings yesterday with 2 separate case numbers.
If they were combined, it would have just one case number I would think and then everything from both cases would be fair game.

I do like her response the state was asked "how was this a mandatory injunction?"...dude said "It would make us have to work(basically)" and she basically said that was status quo...

That alone sounded like she wasn't convinced of the state's argument that the PI was a MI that was done improperly.

I still think the state is gonna lose this one.

Never mind. You are correct. I misinterpreted a previous post to mean the Ninth Circuit had consolidated the two cases.
