03 FFL + COE = Cash and Carry?`
I'm selling a 1952 produced CZ50 and someone claims they have an 03 FFL and a COE and that this permits them to cash and carry the handgun.
Scam or no?

Not in California for C&R handguns, all the 03 and COE gets you is no 10 day wait and no 1 in 30 limit (on C&R handguns only), if the FFL does the DROS correct.

Not for handguns if you are a California seller. In California even C&R handguns must be transferred through an 01/7 FFL. C&R plus COE allows an exemption to the waiting period if the FFL knows how to work the DROS screens and is willing to do so.

It does allow them to cash and carry the same day but the transfer still must be done at a 01 FFL. As for you the seller, you will go to the FFL and do a normal PPT the same as you would for any buyer. It is up to the buyer and the FFL to work out the details of the same day release.
C&R + COE = 1 in 30 exempt for all handguns, including modern handguns. It took a lawsuit to get DOJ to see it that way, but now they do and there is a memo in DES. Last edited by SkyHawk; 01-12-2020 at 7:43 PM.. |
